EAD extension Query

Dear friends,

I would highly appreciate if any could respond to my question. As TSC takes a long time in processing EADs, Is it ok to file the EAD extension 5 months in advance? Did anyone filed the extension over 4 months prior to the expiration date?

I'm kind of worried , whether I can file 5 months before or not.

Hi EDW2002,
I filed my EAD extension in september (ND 09/13/02) and got an approval on 12/14/02. So, it took about 3 months (93 days to be exact). I would suggest you apply at least 120 days (4months) in advance.

Thanks for your information. What was your old EAD's expiration date when you filed the extension ?

I thought of filing the extension 5 months before the expiration date but my lawyer says, INS might send the application back if it is too early.

Any comments is appreciated!!!

No. Lawyer is wrong. You can apply for another EAD even a day after you receive the first EAD.
Sometimes the approving officer takes care and makes the new EAD valid from expiry date of the current EAD.
