Interim EAD

Did u apply in person at the Boston office?

If 90 days is past your RD and if you didn't receive RFE within these 90 days, you can go to the Local office - probably the Portland St, Boston and get an interim EAD. But, remember it is valid for only 240 days. You can make a trip to the office or call them and know the exact procedure....

I got my interim EAD without having to go through layoff or leave of absence.

Congratulations! Must be a relief!

Could u tell which local BCIS u got ur interim EAD from & how many days after RD? Do u need letter from employer stating termination of service in the event EAD's not valid?

RD for EAD renewal: 07.14.2003
Current EAD expires: 08.04.2003
Got interim EAD on 07.29.2003(valid for 90 days)

I went to BCIS local office in Chicago.

I had with me a letter from my employer stating that I will be terminated if I don't have a valid EAD/interim EAD.
The officer just asked why was I late in filing for renewal.
That's it. She asked me to fill in a form. Also they took my finger prints and photo.

Total time taken: < 2 hours

Do I have to get an EAD if I file for adjustment of status?
A6 No. Once you have filed for adjustment of status, there are no additional penalties that attach if you fail to maintain lawful status by letting your nonimmigrant status expire, or accepting unauthorized employment. Your employer, however, can be penalized for employing you without permission.
