EAD expiring next week and renewal not arrived -- please advise

My current (and only) EAD expires on November 19th, 2003.

I applied for EAD renewal on September 22nd, 2003 and the status says that it takes 30 to 90 days to process such cases.

Since I have the receipt for the EAD renewal, am I permitted to work after November 19th, even though the renewal doesn't come in?

If not, what else can I do.

Please help with any advice.

Today I applied to my local sub office in Jacksonville Florida for an extension to my current EAD which will expire in March 2004.

It is advised that you apply for renewal at least 90 days before your current EAD expires. I gave it 115 days , which I hope will be more than enough time to renew my work authorization.

How much time did you allow when you applied for renewal?

If you do not here from them you may be able to go directly to the office in which you applied and get an Interim EAD.

I'm not sure if you can only do this if you applied 90 days before your current EAD expires , you will have to look into this. You might want to get a letter from your work stating how important you are to the company and how important it is to continue working.

As for continuing work.... I have read else were that people kept on working while waiting for their card to arrive with no bad effects , but saying this there is no sure thing when it comes to this immigration mess we decided to get ourselves into.

If I was in your shoes , I would keep on working and hope for the best. I'm not telling you to do this , its just something I would consider myself because I have a wife and baby boy to support bills need to be paid ect.

Thanks for the advice. I applied on September 22nd, 2003 and my EAD expires November 19th, 2003 so that's definitely less than 90 days.

Can anyone else advise how to proceed? It's a sad situation when my company immigration people are clueless about these things which ends up with me having to post here to get info.

No big deal, take an unpaid vacation. Next time, give it 180 days advance as instructed :D

You cannot work or get paid unless you have a valid EAD in hand. The receipt notice is not sufficient.

If your EAD makes it in time then you are lucky. If not, then you have to wait for 90 days from application date, and if you did not receive the card by the 90th day, you can apply for an interim EAD at the Local Office and get it in the same day (the 90th day), until you receive the other EAD from the service center.

But do not work without a valid EAD in hand, it is a violation of the law.
