EAD expires

My lawyer confiremed that Boston INS has stopped processing EAD/AP on same day.

My H1B expires on Jan3rd-2003. If I apply for EAD now and if I don't get it before my H1B expires, Will I be out of status ?
I know that a pending H1B will put you in status. will a pending EAD put you in status ??

I am very concerned about my status now

Not out of status .. work maybe ?

You will not be out of immigration status since your 485 is pending.You will not be able to work though unless you have H1.
