My EAD expired and I have applied for the renewal 45 days back and have the receipt for the same, I would like to know whether I can join a new employer with just the receipt , I have been issued 2 EADs in the past. Thanks , Please let me know , I have a job offer and have to prove my legality to join in 2 days...Thanks

Hi there

Yes, you can change your employer if you want to but still, if you think you can avoid this till your 1-485 gets approved that will be good. Not that its risky to change jobs but at the same time, keep any reasons to minimal when dealing with i485 because these days USCIS just need a small reason to disapprove any application.

Incase you want to go ahead with the change job. Do this.

Along with your EAD card receipt, give them the EAD copies of the last two ones which got approved. You are safe and good to go.

Regards
Anokh

This is completely wrong. You have to have valid EAD in order to work in the US (even for the current employer). Having a receipt on I-765 doesn't give you work authorization, so you have to wait until you physically receive the EAD card.

BE ADVISED, YOU MUST HAVE VALID EAD TO WORK.
There is no exception published.

Hi there,

When you try to change the job and have a valid H1B visa receipt, you still can join that employer? Yes or No?

If yes (I am 1005 sure),w ahst wrong with the EAD? Do you want me to send a email from a Lawyer reagrding this. If yes, I would send this question to my lawyer to get the correct answer. Let me know if you are still looking forward for your EAD.

Hi there,

When you try to change the job and have a valid H1B visa receipt, you still can join that employer? Yes or No? It is a published rule, was addressed several places to switch job after filing H1B

If yes (I am 1005 sure),w ahst wrong with the EAD? It is not published rule, so technically/legally we can NOT continue job on expired EAD, so we should get it renew before prescribbed time publihsed by USCIS to avoid any legal complication.Do you want me to send a email from a Lawyer reagrding this. If yes, I would send this question to my lawyer to get the correct answer. Let me know if you are still looking forward for your EAD.
It is good to ask your attorney.
