Experts,

I have heard from people, if my EAD is expiring and I do not
get the renewal in time, and if I have already filed for renewal
then I can still work, using AC21 law,

Is it true, also I have read several posts where they talk about
getting interim EAD, and you cannot work unless you have
the EAD or interim EAD,

I guess, if anybody knows anything, on this topic let me know,

if an EAD extension is not approved within 90 days, it is automatically extended for 240 days, or until a decision is made, whichever comes first.

You CANNOT work without a valid EAD!!!

If anyone caught with working on an expired EAD,
the employer (not you) will be fined $10,000
a day for each of the illegal work days that
you have worked. I believe there are other
more serious consequences too.

Just be forwarned.

even if you have filed the EAD

Fine,

What about the AC21 rule that once you filed your H1 or EAD
with the TSC you can work,... is'nt it the same as H1 rule,

If not the AC21 law does'nt make any sense,

I am confused, why I can't work once I file EAD and TSC
do not adjucate in 90 days,.. then I should be able to work,
using the AC21 rule, hey but who knows how INS interprets the law certainly as most of them in TSC are spanish speaking, and I think they read backwards, hence they approve 2002 cases first and then 2001 and then 2000 and so on,,..

if u were working on EAD...

and it expired, and u do not have ur new approved EAD , U CANNOT WORK !!!! U have to wait for EAD approval and the physical card to be with u to start working again ...

That is how EAD works .....

If its been more than 90 days since u filed for EAD ... go to an INS office and they will issue u an interim EAD ..

If u had an EAD but were still working on H1 status, and ur H1B is still valid ... u can continue to work ....

No. AC21 says that you can change job after
filing 485, under the assumption that your
EAD is still valid. Make sure that you renew
your EAD before you look for another job.

Cannot work

You have to ask your HR to take you off the payroll untill you get your EAD renewal. If it is more than 90 days you could try the interim EAD route but the dallas DO I heard does not entertain walk in interim EAD's.

Extension of EAD

The following has been taken from http://immihelp.com/gc/aos/ead.html :-

Extension of EAD
It is advisable to apply for your extension more than 90 days before your current EAD card expires because if an EAD extension is not approved within 90 days, it is automatically extended for 240 days, or until a decision is made, whichever comes first.

If it is not extended within 90 days, you can also go to the nearest INS district office and obtain your extension right away.

Procedure for filing the extension of EAD is same as new EAD, except that you should provide the copy of old EAD while renewing it.
