EAD: Can I be with no work

Hi All,

I am new to this forum. I am on H1B. We applied for AOS under schedule A. Recently I got my EAD. My questions are:

Can I be here in US with no job eventhough I have EAD. B'coz with H1B if we are jobless for 2 weeks we shall be out of status. Is there any rules like this if I start using my EAD?

Will there be a problem in future when I renew my EAD? Will they raise questions about my jobless period while I am in EAD?

Once I start using EAD my H1B is invalid afterthat, Is n't it?

Waiting to see your valuable replies..

Thanks,

An EAD is not tied to employment; merely a pending I-485.

No.

Generally, yes.

Thanks TheRealCanadian..

Everybody says not to use EAD if your H1B is valid..
Actually my H1B expires on Nov 2008. Which is best? being in H1B or using EAD? I am confused..

I joined new employer using my EAD. Unfortunately my ead has expired and Im not working now. My employer asked whether I was interested to file H1B. I wasnt sure whether it is possible and didnt want to messup and replied no.

Is it possible to go back to H1B after working for a year using EAD. I moved to new employer at the end of 5th year.

Technically once you start working on EAD and stop working for H-1B sponsoring employer, you abandoned your H-1B status. Now if your I-485 petition gets denied, you are out of status and you will have to leave country whereas if you maintained your H-1B, you would be still in status and you could file new immigration petition.
