EAD approval & I-129

Hi Mr Rajiv,

I had a qn. I applied for my OPT in 2 batches of 6 months each. The second OPT was to continue from 16th jan. However, it was approved on March 2nd. When will my second OPT start- Jan 16th or march 2nd?

There is a 1 or 3 month gap between my OPT expiring and H1. If I apply for I-129, will I be able to work for this company? Does one have to apply for I-129 only after the H1 is approved? Could you advise, please?

++++++++++++++I am not sure I understand the question. I-129 is the form we file to receive an H-1 approval.

Hey
Your approval date is your begin date. What is more important is you is the end date. I applied for OPT to begin in mid of June but it was approved in the last week of July and thats the date I have on my EAD card. July to June

Hope this help.

Ordinarily the two are the same. But not necessarly. Begin date can be upto 6 months ahead of approval date.
