Hi, my wife and I applied for EAD/AP with a notice
date of Nov. 21 2003 for her and Nov. 24 2003 for
me. She has been approved for both but I havent
though I have the receit that INS has received
my application.

Our application was based a pending I485 application for which we have had second fingerprints done already. The dilema is
that my H1B visa runs out at the end of May 2004.
The status inquiry generates the usual
responses which doesnt tell me much.

What advice can people give me?
Thanks,

Since you and your wife has passed 90 days, you can go to the local USCIS office to apply interim EAD. Most time you can get in the same day, it valids for 6 months.

you can take an interim EAD to continue on leglal status or you can extend your H1B for another year.

Hi, thanks, but

1) Im told the Boston INS office does not now issue interim
EAD's (thats where Im located).

2) If I have the receipt from INS saying that I have
applied for an EAD, is that sufficient to keep on working?

Boston office DOES issue interim EADs. Please do not post confusing statements on this website if you are not well informed.

The service is walk-in and appointments are not an option. I showed up at 5:30 am at the JFK building, the entrance that faces the government center, and was the first one there. By 7am, when the doors open, there were about 60-70 people. I got in at 7am and was out by 7:40am. It was very quick and painless.

The only thing they asked for was I-765 receipt, New I-765 application, and a Passport.

Let me know of any other questions you may have.
