EAD/AP Renewal Question

Hi Guys,

Its my time to get ready for AP/EAD renewal.
Mine & Wife's EAD expires on 08/17/04.

As per others comments I am planning to apply (VSC) paper renewal applications by myself.

I have a few questions.
1. I was on on H1B until 12/03 and now I am working using the EAD. Eventhough I have AP, I never travelled using it. So I do not have Parolee status on I-94 or passport. So what am I going to enter as my 'Current immigration status'?
2. My wife travelled using AP. So she has the status as Parolee. So I can enter her status as 'Parolee'. Is it correct?
3. I did not have a H1B stamping as I changed status after entering USA. As my H1B has already expired I do not have a I-94 with a current validity date. So now if I travel using AP will that go on record as out of status at the port of departure? So can that cause me difficulty at re-entry?
4. Also my wife's drivers license (NY) shows 'Temporary Vistor unti AP stamp date' . So after that date how can she get the license extended?
Will DMV accept new EAD or AP without port of entry stamp for extention?
5. Due to the reason that I have not used my first AP will it be a problem for me to renew it?

Any general suggestions/advise welcome in making the renewal trouble free.

------- How did you last entred US if on H1b write H1b and many are confused on this Classof Admission better also write on Cover letter that your last entry was on H1status and your status is AOS pending as you filed I-485 and it is pending

----NO problem, after you filed I-485 the past expired I-94 will not matter

-----I dont know every state has diffrent rules

------YES, Show the EAD and get DL

----No problem, AP is always NEW it is not renewal ,only EAD is renewaed

------Send the color copy of DL , state ID and passport first page color copy with other documents, pay the correct fees(that is increasd) back side of photographs write your name, DOB, A# with pencil

One more issue.

Hi ,
New I-131 form (Application for travel document) has a place to fill 'Class of admission' . What should that be? Unable to find anything about that in instructions pages.

------ many are confused about this Class of Admission, many lawyer say that one must write how you last entred in US if entred on H1 write H1 if entred on H4 write H4, other lawyer says write AOS. The best option is to write on cover letter CLASS OF ADMISSION: My last entry to US was on H1 or H4 status and I have filed my I-485 that is pending.
it will clear your concern to USCIS and they will know what to write and if written wrong they can correct it. sign your cover letter with date, name, DOB, A# and I-485 pending reciept #

Class of Admission Defined by USCIS
We have recently had a number of clients, as well as MurthyDotCom and MurthyBulletin readers, ask us what the USCIS means by the term "Class of Admission" on the new Form I-131, Application for Travel Document. The USCIS has confirmed that they are seeking the applicant's current immigration status. They are not looking for the status at first or most recent entry to the U.S., if different from the current status. For example, if a person entered the U.S. through a Port of Entry and was granted F-1 status, but later changed his or her status to H1B from within the U.S., the correct answer on the form for Class of Admission is H1B.
It is unclear why the USCIS decided to change the phrasing of this question. We appreciate that they have clarified the definition so that we are better able to assist our readers and clients in providing accurate information to the USCIS.

One more quick question.

On my original AP application attorney has filled 'Date of intended departure' as application date - As soon as possible.

Now this is the second AP. Applying 90 days before expiriy of original. So what should I fill in?
I have not used the first AP. Should I send a copy of first AP with this application?

------write any date or' after 6 weeks" they dont care for dates or reason for AP

----- it will not hurt if you attach the copy of your AP with application

Hi Ginnu,

I received EAD cards and 3 copies of AP for both me & wifey.
That step is complete And back to 485 waiting list.

RD for all of above 05/26/04
EAD approval 07/10/04
AP approvals 07/15/04

EAD & AP both issued with approval date as starting date. So effective validity is 11 months for both.

I-485 LUD changed on EAD approval date ONLY.
