Can anyone who got their AP renewed recently comment on how long it is taking these days? I am travelling out of the country on Dec 5. I didn't realize that my AP had run out...EAD is still valid. I am applying for renewing EAD/AP this week. But not sure whether it will get here in time.
Here's the approach I am going to use. Please let me know if there is a better way to deal with this.
1. Apply for EAD/AP for both of us. If AP comes by Nov 15, our problems are solved. Both our EAD's are valid till after we come back....so they don't need to come by the time we leave.
2. If AP doesn't come by Nov 15, we apply for my H1B via premium processing and get it in 15 days. We will have to go to the consulate in India to get our visas stamped.
3. We reenter the US using the H1/H4 visas.
Questions
1. If AP comes after we have applied for H1/H4 or even while we are in India (after going on approved H1), can we just ignore H1/H4, not go to the consulate and re enter using the AP?
2. If my wife does have an EAD/AP (current or renewed), does it become invalid after entering on H4?
