EAD/AP Question

Hello All,
I have a question. I have applied for my 140/485 end of June and my 140 got approved on Oct 1st. I didn't apply for the EAD/AP initially but I applied for them on 10/11/2004. So far I haven't heard anything about them. neither approvals nor LUD changes.

Any ideas? Is it supposed to take longer if filed separately? I am planning to travel out of country sometime end of Jan for 4 weeks. I am not sure if I will get them approved by then.

EAD or AP just depends on when you file them. You should get it probably by the end of this month or by Dec 1st week at the latest. Nowadays, EAD/AP are like hot cakes, served when ordered(I mean when you apply especially in Vermont).

I agree. However, I have seen EAD/AP filed much later than mine (like Oct 28th) got approved though they are filed along with the 140/485 applications. So I am wondering if it takes longer when EAD/AP filed after the 140/385 filing.

Optimistically, it may be that they want to issue FP in my case and so are waiting to do it together

By EAD / AP , I assume you are referring to application for Interim EAD and Advance Parole ?

How would the retrogression affect interim EAD ? When would we get the Interim EAD ?

With 485 application.

EAD is not same as iEAD. iEAD or interim EAD comes in play when it is 90 days past you have applied for EAD and you visit local office to get one.

If your 485 is pending - you are eligible for EAD. Retrogression won't affect it. BUT retrogression might affect filing 485 itself. If you cannot file 485 - you are not eligible for EAD and AP - as these are attached to 485.
