EAD/AP pending for more than 1 year

I got receipts of I485/I765/I131 from USCIS Jan 16 2004, yet still haven't got I765 and I131 approved. To make it worse, when I went to the local office for an interm EAD, they rejected me because my case was put a "hold". I have called the national custom services for many many times, they just could not give me an answer.

Several months ago, I went for fingerprint, and the online status shown the results were already obtained and the latest reply from USCIS told me my I485 is under "security check", which means my I485 is still actively being processed. Then why my I765/I131 are still "hold"? Has anybody met this problem? Can anyone tell me what's going on? Thanks for your kindly reply!

same thing happened to me.

first thing u have to write a letter to ur appropriate service center clearly tell them about ur case and request them to release a hold on ur case. also in the letter ask them ---> what to do to release a hold on ur case??(with bold and under line). so that deffinetly u will get feed back letter from them.

all ways send by conformation mail with usps and also send by fax.(also tell ur employer to talk with them regarding ur case so that ur eployer can get fax number from them)

SAME THING I DID.

from there u can follow up.

------AND also contact your congressman or senator local office, explain in detail to them in writing and provide your all reciept notice copies of I-485, I-765, I-131from there u can follow up.

I agree with Ginnu. contact your congressman IMMEDIATELY. I have a friend with the same problem, she contacted congressman(or congresswoman) they lifted the hold instantly.

Thanks for reply! I've sent an e-letter to congressman, haven't got any feedback(only 2 days).

Actually I've written a letter to VSC as kishsumith said, but all i recieved was a message like "your case is still pending...". They even failed to mention the "hold".

I have one more question. In my case, if I got a job offer, can I go back to my homecountry waiting for an H1-b? I was told by my attorney that I could not apply h1-b in the US.

If the USCIS know I leave the US, they'll stop processing my I485/I131/I765, is that correct?
 
First I don't know why your attoney said you canot apply for H1 in US. If you can apply H1 while in homecountry, you can apply in US as well. I don't understand this statement of lawyer. Ask him WHY can't you apply in US.

Also, if you leave US, USCIS will continue to process your I-485/EAD/AP. The only caveat is you need either a approved visa stamp or AP to enter. Since your AP is still pending, it would be best to wait for its approval and then leave US, if you have to. That is the purpose of AP, to allow you to leave US and reenter without affecting processing of your AOS.
