I am an F-1 Student and I applied for my permanent resident about a month ago.
Anyways, my I-130 pending, I-485 Pending and the I-765 pending. Last updated dates are :

I-130 07/19/2007
I-765 07/09/2007
I-485 06/24/2007

The thing is, I applied for my green cad on December 2005 when my wife used to have a green card. But on June 21st 2007, I sent my file and upgraded the case from permanent to Citizen ship.

I am working now on my (Optional Practical Trainig -OPT) From school. This will expire on August 31st, and I am not sure what to do to avoid losing my job for not having a work permit or EAD.

Another thing, after August 31st, am I legal in the US or not? Because on that dats, if I didn't register for my MBA I will lose my F-1 student visa.

Please let me know if you have any idea.

Best regards,

Ayman

First, get a letter from your employer stating that if you do not receive your EAD, you will lose the job. Take this letter and the receipt for your I-765 and make an Infopass appointment to your District Office and ask them to request your EAD expedited to the National Benefits Center.

Secondly, Your status is no longer ruled by your F-1 visa or OPT. It is now "pending" while a decision is made in your adjustment of status. Meaning until you get your Green Card your status is still "legal" in the USA. Even though you can not work (once the OPT expires) without your EAD nor leave the country without Advance Parole (i-131)

As long as your case is "pending", u got nothing to worry about mate. EADs take 70-90 days to be processed. Would advise you to contact your DO office if they can hook you up earlier with that.

Cheers

I thought you are not in the USA. Did you go over seas???

And thanks for the answers, I didn't ask you directly because I though you are out of the States.

Anyways, do you think they can expedite my I-765?? I HOPE SO

I am leaving overseas tomorrow. I will be back just in time for my interview on the 7th of August.

Anyways, there are some people who succeeded in getting the EADs expedited. Just plead, cry, get a letter from your employer, etc. :) I hope it works for you.

No need to plead, and Cry. My wife will deliver our baby in this week (hopefully), and she is not working. That's why I need it so bad.
But I

But I was trying to set up and appointment, and the website states that to schedule an appointment for the I-765, it should be over 90 days .

What do you think?

Can I use the below option for an appointment ??

EAD inquiry appointment - If your I-765 employment authorization application has been pending for more than 90 days.

I work for HP and they have strict rules.

I scheduled an Appointment for August 2nd. Let's see if they can help me with that.

Wish me Luck folks,

Ayman

Just schedule one to speak with an immigration officer, or whatever is the soon-est :p and bring an EDC from your wife's OB. (Estimate Date of Conception, delivery).
