EAD and married to a person in india.

Hello

My case I485 pending and I140 approved.
I have been on EAD for the last 2years after my H1-B expired. Can I get married to a girl from india and come here? -or- better
Is there a way to get the girl here in any way possible ? What are my options?

In my opinion, you gave up your non-immigrant status by not renewing your h1b or using EAD. Since you are an immigrant now, your spouse would have to follow the immigrant process. When the priority date becomes current for her, she could apply for CP..gurus can correct me if I am wrong.

Otherwise, she could come here on any non-immigrant visa like, F1, h1b etc. I am not sure if would get them easily if you were already married..you know what I mean?

I am sure I dont sound like a lawyer hence you should talk to one :)..and use your own judgement.

ur best option is to apply for a new H1b for urself. u can do that with your current i-485 sponsoring employer.
This should not have any bearing on ur GC application.
once you get your H1B status back. Your wife will automatically qualify for H4.
DO NOT FORGET to send a letter to the consulate, with your wife, stating your current non-immigrants statuses so far, in chronological order. Also state the obvious that your wife qualifies for H4 under the current rules.

Options:
1) Apply H1/L1 for spouse if she qualifies for one
2) Apply F1 for spouse (no easy to get as you have applied for GC)
3) You convert back H1 and she applies for H-4
4) Wait till your PD becomes current, she can apply for counsular Processing
5) Find a spouse from US
6) Head back to India
