My wife is currently on H4 status valid until Sep 06. Her AOS is also pending. Her EAD based on AOS applictaion has already expired. She never used the EAD (got SSN based on EAD), and DOES NOT INTEND TO USE IT IN THE NEAR FUTURE. My question is - is it a must for her to renew her EAD? I just want to make sure that there are no potential issues (RFE) etc. with regards to her pending AOS.

-------------not must if she does not want to use EAD

----- if she has to go out of US and her H4 Visa stamp expires then she will need H4 visa stamp from consulate based on your H1 or need AP applied in US and approved before her departure from US if she wants to use AP for entry to US.
 
My wife is on H4 visa valid up to 01/10/2006. She got the EAD. After that we applied SSN for her using EAD. But she is not working. Is her H4 expired since she used her EAD to apply SSN?. Is her H4 still valid?. Can she go india using H4 without using Parole. Please advice.

Travel on H4 visa while using EAD

My wife is on H4 visa(stamped) valid up to 05/01/2006. She got EAD. After that we applied SSN for her using EAD. But she is planning to work. Is her H4 invalid since she is going to use her EAD to work. Is her H4 still valid?. Can she go to India using H4 without using Advance Parole atleast until 05/01/2006. Please advice.

-----------for going to India she dont need H4 visa stamp or AP, she needs valid AP approved before she go out of US if want to use AP for entry to US
or valid visa stamp to enter US
** if she enters US again showing H4 valid visa stamp at POE before05/01/2006 then she can enter on H4 status and will get I-94 based on H4 visa stamp validty

Thanks for your reply. I'll put my question directly
My wife's H4 visa is stamped until 05/01/2006. If my wife works on EAD and she wishes to go to India before 05/01/2006 and wishes to come back showing stamped H4 visa at POE before 05/01/2006, does it make her EAD invalid?
or
if somebody uses EAD, they need to have AP to come back to US to retain EAD status
Please advice
