I was laid off recently and I have EAD card with me. Can one work as a consultant on EAD?
In case RFE is issued for 3 latest stubs and proff of employment will working as a consultant be valid.

In these tough economic times it is easier to get consulting work for 1-2 months rather than full time employment.

Any information in this regard will be appreciated.

u can easily find a compny who can give W2 for ur consulting work. u might hv to pay them little amout but it can be done. As a direct consultant though there's no harm but these days its getting kinda tricky. Choice is urs.

I think you need to have primary employment

You can use AC21 to change job, but I don't think you can only do 1099 consulting work by yourself. When you change job under AC21 your prior compnay responsiblity as sponser will shift to your new company. but for consulting work it's not the case.

As ghost-rider suggest you can find company who will be your new company, than you need to pay them some percentage.

I hope this helps.

Why not form a company yourself ( inc.) and work for your own company. INS will not ask for financials/owner information. Technically you can then prove that you are working for a company.. I have heard a case where a petitioner did that and got approved,, when some one questioned if thats legit or not. The lawer came back and asked him to show the law where he cannot do it.... Offcourse, finding a full time job is the optimal solution for it.. Otherwise, " Necessity is the mother of invention"

You are right Sunny about " Necessity is the mother of invention" ,

But Technically you can not be your own boss similar to you can not sponsor you h1.

if you have any dependent and if they have EAD then they can start firm and then you can work for them.

I hope this helps.

Ac21 doesnot bar you from forming your own company and work Its pretty much legal . but if questioned during an interview you might have answer plenty of questions and then it will depend upon the person who's interviewing u to approve your case or not. Chance are pretty good if you are doing similar job work but there's negative side also and u will be takeing slight risk.
