EAD and AP without Job

Hi,

my wife's company sponsors our EAD. I got it because of being her spouse.
Is it possible for me to keep working on my EAD (and renew it) when she would resign from her job? Similar - is it possible for us to keep renewing Advanced Parole Travel Permits when she would not be working anymore.
What are the limitations if she should resign?
We will have to wait for our GC for quite some time apparently (EB-3 Europe).
Does anybody have any clue how long it takes before the EB-3 date currently at 01 April 2001 for us would move to early 2004? Six months? 2 years? Longer? Any prognosis - or is their no way to know?
Thanks,
S.

actually we are just guessing....but for it to reach 2004, for eb3-world....it may take atleat 2-3 years...

There is no such thing like EAD sponsored by employer(Unless EAD was obtained with L2 visa). If you and your wife got EAD because of pending I485, EAD/AP is valid as long as your wife's I485 is pending, no matter who she is working for, but one important thing to remember is she has to have a job or job offer to keep I485 going. Don't forget to file new EAD every year.

Employed by whom?

Thanks for the quick responses.
We did get our EAD because of pending I-485.
It was mentioned that my wife needs a job or job offer to keep the I-485 going. Does anybody know whether it is OK for her to incorporate or for me to incorporate and hire her? Would this satisfy the requirement of "being employed" so that the I-485 can continue being processed?

Thanks again,
S.

Then you need support from a US citizen since you are related and owe more than 5% of the company :) Check out forum for "doing business in the US" to know more. You don't want to try that risk :)

It's not just about "being employed", it's about having a same or similar job (or job offer) as the one for which the I-140 was filed.

EAD good enough to Incorporate w/o Support

Thanks everybody,
one last verification - please.

Can my wife incorporate based on her EAD without external support from another company? She would be doing the exact same work.

I am in the same bsuiness also. I could take her in my company but I understood this might be risky because we are related and would kind-a be supporting each other...but I'd still love for clarification to my question whether she can incorporate herself? I'll check the other Forum recommended.

It is pretty important for us.

Thanks again for any final responses.

S.
