EAD and AP sent to the wrong Service Center

I am a just new member to this Forum and I found it very useful.

Well, I have an immediatel and urgent question to for all of you.

I have hired a lawyer to help me to renew my EAD and AP. Both of my EAD and AP will be expire on 11/17/2003 and 10/24/2003 respectively. At the same time, my pending I-485 has been with NSC for more than 180 days.

Supposedly, both renewal applications should be sent to NSC but they were accidentally submitted to VSC by the lawyer. He forgot the fact my I-485 pending at NSC even though I am located at Buffalo, New York.

Both renewal applications's receive date and notice date are 06/20/2003 and 06/24/2003 respectively from VSC.

I talked to the lawyer and he told me that it would be fine because VSC could actually working on my case and it would even faster than going through NSC. He mentioned that VSC could locate my case from the centrailzed system and eventually approve my case from VSC.

Have someone come cross this type of situation and actually gone through without any difficulites ?

I think your lawyer is trying gab through the mistake. With details like I140 approval or pending missing, VSC is going to generate a RFE is my guess. If your lawyer thinks that VSC has to handle your case why did he not do it the proper way (file for change of address and request transfer).

As a contingency I would suggest filing for EAD/AP with NSC. My thinking is that unless NSC comes around and says , your 485 application has been transferred to VSC or to a local center you should keep applying with NSC.
 
Your case might get transferred back to NSC. My I-485 (WAC-02-120-XXXXX) was pending with CSC and I joined new company in WA state which applied for my EAD (LIN-03-157-xxxxx RD 04/15/03) & AP renewal at NSC. After the long wait when it came to approve my renewal case on 06/26/03 NSC has decided to transfer my EAD renewal case to CSC. Now CSC says it will take another 120 days to approve since it just recived my case. Due to this I am not able to work from this week onwards. I am planning to go to Portland or seattle office to get my iEAD on monday 07/14/03.
I am hoping they issue me a iEAD and not raise the transfer issue.
I don't know what you can do now in your case.

I had talked to couple lawyers and they agreed to file brand new EAD and AP renewal applications to NSC instead of waiting for VSC to transfer both applications.

But they have different ideas of whether there is a need to send a request letter to VSC for withdrawing both applications. One said to wait for any RFE from VSC and then response to VSC about the mistake that has been made at the beginning. One said to file a request letter for withdrawl. Don''t know what to choose at this point.

Well, I am preparing to file new applications to NSC but it seems like there is need to have a cover letter.

Jaxen, could provide some examples of the cover letter for renewing EAD and AP ?.
