EAD and AP ... Question ...

Hi,

Was wondering if anyone could help with a question. I mailed my AOS package in August along with the EAD and AP forms. I had sent it to the Chicago Lockbox facility. My District Office is Oklahoma City. I just looked at the processing times and Oklahoma City is now processing APs with receipt notice of Sept. 9th and EADs with receipt notice of September 6th 2005. I have yet to receive either document. It says if my case was filed 30 days or earlier to the dates that I mentioned to call the 1-800 number. It is not yet 30 days, but almost. I will surely call once I hit the 30 days.

Question is how would they be able to send me my EAD if I have yet to receive either the figerprinting or biometrics notice? How could they be processing EADs from notice dates of Sept. 9th with no fingerprinting/biometrics notice? Is there something I'm missing here?

Any help is much appreaciated.

You have to look the dates at the National Benefits Center or NBC not in your DO for EAD. I don't know for AP probably the same. If you see the dates are still for August.

I mailed my applications (EAD/AP/I-485/I-130) august 3, 05. I am still waiting for FP notice. I am guessing my EAD will not be approved without FP notice. It's almost coming to 3 months now. I did get RFE for I-693, which I did not mail along with my original application. I checked the dates on NBC and its August 7. I should have recieved something by now.

Well, if you've hit the projected timeframe, I think you're supposed to call the 1-800 number, detroitkam. According to my on-line status, we're supposed to call the 1-800 number if we don't receive either the EAD or AP within the projected time frame that they've listed. I guess you can make an infopass appointment to get your EAD, if it's not received by then. They'll proably give you an interim EAD till you can get your real one.
 
Yes I responded to RFE within 15 days. I had 80 days to respond to it. I know RFE causes the process to slow down but at least I should have received a notice for FP. I think I am going to call 1800 number first thing monday. I am not too worried about EAD as am currently on TN visa which is valid till May, 06.

Looks like we're in the same boat, Detroitcam. I'm also a Canadian on a TN Visa. I moved down here (again) with my American wife this year due to work. We finally decided it's best to stop moving around and file for AOS.

They might put us at a lower priority than the other folks in regards to the EAD as we can still legally work till our TN visa's expire next year.

By the way, judging by your early August date, I gather you've received your AP by now, correct?
 
No. I haven't received anything yet. Just RFE for I-693 which was almost 2 months ago. I dont think it should matter what your current status is. Where are you located? In Detroit? Can you tell me what your timeline is? Did you get your FP notice. I know I won't get EAD approved without FP.

I filed my medical with the other forms, detroitkam. I'm actually in Oklahoma. I filed after you did. My Date of Receipt is mid-late August. I have not yet received my biometrics or fingerprinting notice.

What I'm more concerned about is the AP. I'll need it to travel this Christmas.

According to the NBC processing times, they are now processing APs and EADs filed around the first/second weeks of August. So they are most probably prosessing both your AP and EAD now. Check your on-line status to see how long they indicated for the projected time frame for your AP. This will tell you if you can call the 1-800 number to schedule an infopass appointment to get your AP at your local DO office if you don't receive it shortly. As for the EAD, they will give you an interim one (thru infopass appointment) if you don't get it by the projected time frame as well.

They might wait to schedule both the fingerprinting and biometrics at the same time to take care of the EAD and AOS. Not sure.
