EAD and AP delay

This is the first renewal application after the transfer to TSC. Our lawyer has probably sent it to VSC instead of TSC - we applied for renewal mid-November. Our AP has expired and EAD will in May. The lawyer (a new one) now is trying to fix the error in filing. Is there anything we can do while the lawyer is doing his own thing trying to followup with the service center? I read there is something that will allow us to be in status even after May (EAD expires) for 90 days or so, assuming that EAD gets rejected because it was allpied > 120days before EAD expiry? TIA!
 
I did the same: sent my AP and EAD to VSC even though my case was transferred to TSC.
However, I got the applications back with a note saying that I need to apply at TSC. It took me about 70 to get my application back (lightning fast, I agree).
I then sent it to TSC and it got approved in a matter of weeks.
If you're desperate, try to send in another application and see if TSC will approve it! :)
This is half a joke. I don't know what'll happen if you send in two applications so don't go by my word regarding this.
 
Well the first thing I would suggest you to do is fire the attorney and remove his name off your case. How come he doesn't know where to send the application? Next would be for you to wait till your application comes back from VSC, before refiling at TSC.

I'm tempted to make an observation: it's very hard to say whether the attorneys or the USCIS are more incompetent.

nj_skm, it is very confusing now for me. I spoke to IO (?) at the USCIS 1-800 number on friday and this officer told me that VSC will process the applications and that they are processing around the date our applications were received, so we should hear from them soon. How come you received a letter saying you need to apply at TSC and not VSC I don't know. Why there is no consistency in their rules or are the IOs not trained properly?? either way it is giving us unnecessary tension, let alone GC, now even getting these EAD and AP documents are becoming a PITA. For now we will just wait for attorney to followup and get back to us with a POA. Thanks for your responses.
 
My attorney also had done the same mistake. Our EAD took 2 and half months to come. It came from TSC service center.

Zooni, did you have to reapply with TSC or was it done transparent to us applicants, meaning VSC transferred to TSC and you received the documents from TSC?

I think the rule is that you send it to the same service center where you filed your 485 application.
No one knows (probably including the USCIS) why they redirected it to TSC. Maybe they sent all my paperwork to Texas and don't have my files for reference.
Who knows? Who cares?
I've turned stoic about my 485 processing and have learnt to roll with the punches.
In time, according to the "TAO of the customers of the USCIS", you will eventually too.
I'll go back to my meditation.
 
actually now the rule is u apply to the service center whose jurisdiction ur current address area is.

Put in Service request for both of our EADs and APs. Hope to get approvals before we have to hear the excuse they come up with for the unreasonable delay. Applied for renewing AP and EAD on 16th oct '07 and no news so far. APs have already expired...EAD will mid-May :(
