EAD and Advanced parole

Hi ,

I am on H4 presently, my wifes co will be applying for I485 soon, I just wanted to know that after we recieve EAD do we require to file for advanced parole to travel or can we travel on our existing visas which are valid till dec 2005,

on some websites they say you can travel and some they say consult INS as the law is ambigious

please let me know if you have any info

If EAD is not used and H1 status is maintained - you can travel on H1b visa - no issues.

-------- you need AP approved in hand before you go out of US as you are using EAD you need AP. If you use H1 Visa for reentry you can do that and will be admitted on H4 status with I-94 showing H4 status. If your spouse who is/was on H1 used EAD then you must get AP approved IN HAND before you go out of US( it is taking 5-7 months for AP approval)
