I am planning to use my EAD to switch company. My current EAD is upto 04/30/05. I am sending documents for renewal next week.

My question is if I don't get approved withing 04/30/05 what will happen?

Am I out of status? or Can I work If it is applied?

Please help me understand this issue.

Send the application by 01/30/05. In 90 days you will be eligible to get an Ememrgency EAD from the local office.
 
You will not be out of status even though your EAD expires. Once you get the emergency EAD, you can continue working.
 
If you wond get EAD or IEAD by the time your EAD expires you will be considered as working without authorization and fined $1000.00 . Your Employer may be penalized too for employing a person without work authorization.

Submit your EAD online ASAP and later you can mail the documents. Remember the date of filing is what counts. so if you file online the date of filing is today....

What is the process of getting temp / Interim EAD. I know it has to be 90 days from the date applied,but how long will it take to get IEAD, where and who should apply for it (Me or my lawyer)

You have to apply for it in your local Application Service Center.
You'll need your filing copy, previous EAD (if any) and Driving Licence or some state issues Photo ID
Generally you will get it in one hour. Any way you'll get it the same day.

You can work 3 months without having EAD and IEAD if you file even 1 day before your currect EAD expires...This what my attorney told me...

Filing 90 days concept only apply when you need some document with you for driving license etc. purpose...

Even though he's an attorney and I am not, I will tend to disagree. Once your EAD expires, you cannot work, period.It does not matter that you have a pending EAD application, what matters is you should have an approved and current EAD at all times (assuming that is the only work authorization you have,and do not have a H1 etc. to fall back on).
