Note: There are no more cases for I140 after 53000.

It is kind of very frustrating. USCIS is only approving 1 or 2 cases in one week. I read a post stating that USCIS is planning to put more staff to take care of I140's. I do not see any staff being put work as yet.

I don't know your source for this info. What I learnt from Murthy's chat is that BCIS is planning to assign staff that comes out of H-1B processing after H-1B quota is reached some time in near future.

Who knows what could happen to that staff in future? They may go to process some thing else (which BCIS thinks meaningful) rather than processing employement based applications :mad:

Btw, on my I140 an RFE has been issued.

I do not know the details of it. I will post the details of it as soon as I receive the details of it.

I guess your case is EB2. or is it EB3? Why an RFE is issued after one year? Why was it not issued when EAD was applied for...i am assuming you applied for EAD/AP.
 
My case is EB-3.

I received the copy of the RFE today. USCIS is asking for the capability of the owner to pay the profered wage or salary.

They need the Federal income tax return of the company and my W-2 for year 2003.

The problem is that I worked only 10 months last year.

So, the wages shown on the W-2 will be less then whatever is specified in the labor certification forms.

But, I have all the pay stubs for 10 months.

Please discuss, if it will be a problem.

W2 and Paystub

This is a common scenario. There are several threads on the forum which are discussing same issue. You attorney should be able to handle it by getting the company to write why there was only 10 pay stubs. ...
