E2 Spouse/Dependant questions

Hi,

I am currently holding an E2 visa, and my wife (dependant) an EAD card via my E2 visa. We have some questions:

1. If I (principle E2 holder) quits or is laid off by my employer, thus losing my status as E2, what will happen to my wifes EAD card? As she is a depend on my E2 visas, will she lose her EAD card and employment privilages?

2. Can my wifes employer support her GC if they decide to? is this possible even if she is an dependent? or can she ask her employer to support her GC?

1) Yes, she will lose her status
2) Her being a dependant has no bearing on her ability to file a GC

1. how long does it take usually to apply and recieve the EAD card?

2. Does she physically have to be in the US during the EAD application time? or can she be out of the country, then come to US when she recieves her EAD card?

Processing times vary. Check your local processing times at: https://egov.immigration.gov/cris/jsps/ptimes.jsp;jsessionid=ck3KH5nDamA_. Please note that new changes state that E-2 dependents will no longer need to apply for EAD. However, I'm not sure when that law goes into effect.

She should be in the U.S. while the application is pending.
