E Filling I-129

Just wondering if anyone has E filled I-129 recently. I'm right now working on renewing TN status from the US for the 1st time and 2nd renewal.

I was reading the USCIS site and E filling seems to be available now. I have a few questions about it thought:

1) On concurrently filling I-539 for my family, looks like a single payment has to be done, How is this going to work? I was on the understanding that I couldn't pay for my own visa so my employer would have to do it, does this mean I'll have to arrange this with them?

2) How about filling birth/marriage certificates in spanish, Do I need to translate these?

3) What other paperwork do I need to send after?

Thanks in advance.

Let me add another question:

Is it allowed for me to pay for efilling I-129?

Manuel.

1. Only H1 processing must be paid by employer. I-129 for TN can be paid by anyone.
2. They should be translated.
3. Your I-129 application will tell you: TN letter, copy of degree, etc.

OK.

Thanks Nelsona.

I was hoping i wouldn't need translation on Birth/marriage certs since they Visas are already linked to me as dependents from a previously approved Consular procedure. i'll get working on them.

Thanks again.

No doubt you were dealing with a consualte in latin america, which is State department. CIS may or may not have a policy on Mexican documents.

OK.

Last doubt, on translating birth/marriage certs, according to USCIS site: http://www.uscis.gov/portal/site/us...nnel=9059d9808bcbd010VgnVCM100000d1f1d6a1RCRD

"Translations. Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that he or she is competent to translate the foreign language into English."

So according to this, Can I get a notary to certify these or does it actually have to come from an official translator/agency?

From the attached "Instructions ofr Form I-129, Petition for a Nonimmigrant worker", page 17:

"If requesting an "Extension of Stay" in TN classification, submit evidence, such as a letter, describing te continuing empoyment and evidence of the beneficiary's comtinued valid licensing (if required by the profession and/or state"

So, Do we only need a new job letter?? What about any education transcripts, passports, etc? Anyone with recent experience on either mail-in or e-filling I-129?

Obviously, if you e-file an I-129, you are expected to submit a copy of all suporting documents, which for TN are a TN letter, a copy of your degree and passport.
E-filing is not magic; it only permits filing the I-129 form itself and paying on line, and gives you a petition number. Every thing else that is sent with a regular I-129 still must be submitted soon afterwards.

Thanks Nelsona.

I get that, I'm just confused and surprised that I maybe over worrying about this process. Hopefully it'll be OK.

I'll keep everyone posted with the results.

I was just about to mail my I-539 today and when i was making certain i had the last edition of the form by checking on the USCIS site, I found that the one I have seems to be a newer version than the one listed as current on the site:

http://www.uscis.gov/i-539

http://www.uscis.gov/files/form/i-539.pdf

and the attached would be a copy of the one I filled out. Should I re-fill the form so I make it match the site instructions?? I do remember for a fact that I've download that copy from USCIS, i just can't remember the excat date I did it but it wasn'y more than a month ago, still the copy I was about to submit says it will expire on 02/29/2012 while USCIS current instructions call for the latest to be the 01/19/11 version.

Any ideas?

The one you have is actually an older version from 2009 (06/12/09).

(a) Why would you think a form with an older date is a newer version?
(b) Why would you not simply use the current form?

Although technically, because of the (Y) after the rev date, you can still use the older 2009 one, why would you bother. It takes 2 mimutes to fill the correct one.

I was just reading the instrctions to fill I-539 and you're totally right as it does specify that the revision date is not the one on the top right corner as I was doing it by taking a look at the 1st page top, but the one on the lower-right corner.

the question wasn't about filling it again, but about my confusion as I thought I was using a weird dated form. I'm working on re-filling to the new version again right now.

Thanks for the input.
