hi everybody

we from West Africa, my wife as principal applicant and me as a beneficiaries.
we did our interview on april 25 2006 as CP in dakar- senegal. the consular officer a lady said
1- my wife is not qualify for the visa because her occupation is not accepted.

2- my finger print pop up on the screen showing I was arrested in USA.

my wife filed for job experience on DV application and she is a high school no diploma after she did associate degree in IT management in Senegal(we didn`t mentioned on dv aplication). she had 3 years of job experience 2 for sale agent for computer and IT material and 1 years as costumer representative for telecom companies in a call center.

me I graduated in montreal canada from 1998 to 2001 and used to travel to USA as B1 or B2 visa. on Jully 3rd 2000 I was involved in a fight in Maryland (night club) and i was arrested and realese next day. I went in court on 12 september 2000 and a Nolle Prosequi was entered (dismissed).

Then after a long discution with the consular officer we told her my wife had a associate degree but she didn`t have a high school diploma. she told to bring a copy and original of the associate degree and she gonna investigate by office in DC about my finger print or my arrest.

From that day i contact the District court of Maryland and i filed for Petition for Expungement of records form 4-504

we come back on 6th june at consular office to bring the original and copy of associate degree of my wife and they said they will contact us.

June 20 2006, i send email to consular office about our case and they respond me:

Dear Mr. xxxxx:

In order to proceed with your application, this office must confirm your eligibility for that visa. We will contact you if we need additional information or if we need to conduct an additional interview. Until we have completed this verification process, we cannot move forward with the visa application. As each case is unique, we ca not predict how long the verification process will take.

on July 16th 2006, I receive the order for expungement of police and court records from district court of Maryland by mail.

Now i think they doing security check or name check in DC and we are very anxious about 30 september.
 
Should you take the court records to the consulate to show them how minor your case was? I am still stuck in name check also, but I am doing AOS. It sounds like your case might be quite complex - good luck!

There are a couple of posts on the board about people who were stuck in name check during CP. If I remember rightly, the consulate can ask the people in DC to hurry it up.
 
I am so sorry to hear about your case,frankly speaking,it's quite pathetic!
I do not think you were refused the visa because your FP popped up in the system during your interview,as I have read about a case in the forum about a guy that had similar case and didn't even have a job and yet, his Visa was approved.Your FP coming up is just...
If I am to refresh your mind,in your NL for the DV,it says the basic requirement is that you must have either a high school education or it's equivalent or two years work experience.
A high school education simply means successful completion of a formal course of elementary and secondary education comparable to completion of a 12 years course in the U.S. (i.e Six years in primary school and 6 years in secondary school)
You need to understand also that it is the primary applicant (Your Wife) that need meet these requirement.
But if, the consular office had wanted to use his/her discretion to approve your wife's case base on the associate degree she has..then it's at the consular's officer's discretion.
You having a master or otherwise wouldn't really matter unless it was the other way round.
Judging by your write up here,I think it's on these ground that your visa was disapproved.
I must tell you though, I am not an expert on this field,this is just my opinion.

But but the consular officer said at the first interview he gona investigate about me with washington DC officer. For my wife she just ask her to bring the associate diploma and we did it.

for my opinion they are doing a name check.

my question is if name check is not done before september, they can process my wife case.

We still waiting and crossing our fingers. 2 weeks ago I send e-mail to consular about 30 sept deadline and notify them about job experience qualification and school record of my wife.

they wrote:

Dear Mr. XXXXX:

Thank you for the information below. We will look at the case again. However, there is no guarantee that the verification process will be completed by the September 30 deadline.
