DV2006. 2nd letter

Hi, we (my husband is the winner) received today the second letter. Isn't it too early for USCIS to send us this second letter since our number is EU93XX? Should we do the same as Boris did and send all papers to our local USCIS office? Or should we wait until our number becomes current?

The 2nd letter says:

"You MUST submit the Diversity Visa "Notification Letter" we sent you to the USCIS office nearest your place of residence in order to apply for adjustment of status. You may apply to USCIS for adjustment of status from October 1, 2005 until September 30, 2006. However, your status must be adjusted by September 30, 2006 as DV-2006 expires on that date."

What we concluded from this letter was that we can already apply. Any thoughts???

My husband works here in the US and he filed a company-sponsored green card application in April 2003 but until now we could not even get the labor approved.

My question is: If we go ahead with our DV application and then we get our labor certification approved, can we continue both applications? We opted for AOS.

Send docs. or mail them?

I won't be able to do it right now anyway because I still need to do the medical examination and translate some documents.

Also, I would like to say that in our case, we ended up sending all the forms to USCIS, I mean, both DSP-122 and DS-230 (Parts I and II) because at the time we sent them, we didn't know that if you were doing AOS you only needed to send the DSP-122.

And my question is: When sending all the docs. requested, should we take them personally to our local USCIS or would be best to mail them?

I-485 and supporting docs. must be sent to Chicago Lockbox

Reading through the instructions on Form I-485, I realized:

1) Together with form I-485, we also need to submit:

Birth Certificate
Copy of passport page with nonimmigrant visa
Photos (2)
Medical Examination (Form I-693)
Biographic Info (Form G-325A) if >14y.o.
Affidavit of Support (or proof of being employed in the US)
Paid fees ($70 + $325 OR $225 if < 14y.o.)
Receipt for $375 paid for U.S. Department of State


2) The right place to send it is:

For USPS deliveries:
U.S. Citizenship and Immigration Services
P.O. Box 805887
Chicago, IL 60680-4120


For non-USPS deliveries (like Fedex, UPS):
U.S. Citizenship and Immigration Services
Attn: FBASI

Hi,
I am also a winner of DV 2006. Currently I am doing AOS. I submitted appplication package for myself, my husband and my son to Chicago lock box facility, got my receipt number and now waiting for fingerprints date to be mailed to us by the USCIS.
After reading the postings I got confused, because you guys say that in the original package one should include receipt of $375 per person DV fee paid to the State Department.
In the second letter I received from KCC it says that we should pay this fee after our case is accepted by USCIS and bring the receipt to our interview.
And I didn't find it anywhere in the I-485 instructions stating that one should submit the above mentioned receipt to the USCIS with the original applications package.
Can anybody explain, please?

I didn't pay fees to KCC when I submitted my AOS. Soon received letter from USCIS requesting to pay fee to KCC and send them back receipt from KCC.
 
question to accountant

did you already get your fingerprints date? how long after submision of your original package did you get your notice to pay dv fee to KCC?

I appreciate your reply to my question. I guess I am going to pay it now and submit it. To which address should I send a copy of my receipt? Or should i submit the original receipt?

Actually YOU ARE RIGHT. I got confused first but then, I reread the two letters again and realized that you do not have to send the receipt together with your I-485.

In the 2nd letter that we received from KCC it says:

Dear XXXX,
Thank you for informing us of your intention to apply for AOS blah blah blah…. You must also be sure to follow the instructions on the attached sheet concerning payment of the Diversity processing fee. This fee must be paid prior to USCIS taking action on your adjustment application
.”

Next paragraph says:

You MUST submit the Diversity Visa (DV) “Notification Letter” we sent you to the USCIS office nearest your place of residence in order to apply for adjustment of status. You may apply to USCIS for adjustment of status from October 1, 2005 until September 30, 2006. However, your status must be adjusted by September 30, 2006 as DV-2006 expires on that date.”

The problem is that there was no “attached sheet concerning payment of the Diversity processing fee”. The only thing inside the envelope was the 2nd letter from KCC in one single sheet. So, I referred to the instructions on the 1st letter. On page 4 of the first letter it says:

In order to complete payment of this fee, once the USCIS has accepted your case, fill out the receipt form at the bottom of this page, cut it off and mail it along with your cashier’s check, or U.S. postal money order (made payable to the U.S. Department of State). Also, you must include a stamped, self-addressed envelope in which this receipt, stamped to confirm your payment, will be returned to you. You should present this receipt to USCIS at the time of your adjustment interview. Failure to do so may delay the processing of your case.”

What does it mean “once the USCIS has accepted your case”? When does it happen? By receiving the 2nd letter, my case was accepted by the USCIS? When should one pay that fee?

I think if you send your papers (485, etc) to the USCIS but do not pay the $375 fee, your case will get stuck. They will only move your case forward if you pay that fee. I also think it doesn't mean that you have to send the receipt with your application, but only that you must pay the fee and keep the receipt with you to take to the interview.

Any thoughts?

case accepted

hi,

Your case is considered accepted once you submit your original application package to the USCIS Chicago lock box and the USCIS reviews it, accepts your forms' fees as complete and sends your back a "notice of action". It means the form I-767 that includes your receipt number (your case number) and says that you need your fingerprints to be taken. Only after receiving such a "notice of action" you may submit your DV fee to the State Department.

This is acutally what i did. So far it works well :-)

I didn't get FP date yet, still waiting.

It took about 3 weeks since I submitted application and received letter requesting Fee payment.

When USCIS sent me request for the fee payment, it attached envelop with preprinted USCIS District office address on it.

I sent copy of receipt and kept original for interview.

Forms 770 and 703

Today we scheduled an infopass appointment (we are in California-Santa Clara County. It was pretty easy, there were lots of time-slots available).

The immigration officer gave us all the forms that we need to file. Among those were form WR-770 (SNJ) 2211-Memo to National Visa Center and form WR-703-Processing Sheet.

Does anybody know about them? Did anybody file them with their AOS applications? :confused:
