Hi,
Am Wondering If Anybody Can Help Me, My Dv2055 # Became Current In Jan05, But My Laywer Has Adviced Me Not To File Because I've Been Working Illegaly. I Have Been In School All Through To Maintain My F1. Is There Anybody In The Same Situation? My Lawyer Sujests To File In Other States Except Ks & Mo.

1) Did you work for a check or cash?
2) If you got paid by check did you make more than $600 at the job?

If you got paid by cash and nobody caught you, you might not have a problem.

However, if you made more than $600 during the year and the employer had your social security you would have to file your taxes. If INS checks your tax return they might have a red flag. But again, they might not do any checking.

Here is the situation: if you made lots of money while being on a student visa - this could be visible and the INS could check on that.

If you are going to file in another state do it in Texas. They have Pilot program that expedites the AOS. In Texas you can get your G.C. interview in the same day you are filing for adjustment of status! Very fast.

Why don't you ask another lawyer for advice? Most of the time you can get a first consultation free.
