DV Question

The DV-2007 instructions require that you provide the details of all children who are unmarried and under 21. I have two sons over 21.

"12. NUMBER OF CHILDREN THAT ARE UNMARRIED AND UNDER 21 YEARS OF AGE – Except children that are either U.S. legal permanent residents or American citizens."

No problem there. Maybe I'm reading it wrong, but # 14 seems to ask you to include all children even if they are over 21, despite the fact they won't qualify (I'm guessing this is just for their complete records?) and that "failure to list ALL children" will become grounds for disqualification.

"14. CHILDREN INFORMATION - Name, Date of Birth, Gender, City/Town of Birth, Country of Birth, Photograph NOTE: Entries must include the name, date and place of birth of the applicant’s spouse and all natural children, as well as all legally-adopted and stepchildren, who are unmarried and under the age of 21 at the time of entry (except children who are already U.S. citizens or Legal Permanent Residents), even if you are no longer legally married to the child’s parent, and even if the spouse or child does not currently reside with you and/or will not immigrate with you. Note that married children and children 21 years or older will not qualify for the diversity visa. Failure to list all children will result in your disqualification for the visa."

What should I do? List no applicable children for # 12 and then list all my children (over 21) for # 14 and also provide their photographs?

I have read that once you get chosen and go for the consulate interview, if you include any additional names that were not part of the original application, your DV entitlement is automatically rejected. I'm not sure if they ultimately ask you for all info about all your children (again just for their records). Can someone who has been through the whole process help clarify?

Thank you.

Surely there are thousands of applicants with children over 21...

Surely there are thousands of DV applicants each year with children over 21! Any help here would be most appreciated. LucyMO?

No. 14 clearly states that "Entries must include the name, date and place of birth of the applicant’s spouse and all natural children, as well as all legally-adopted and stepchildren, who are unmarried and under the age of 21 at the time of entry (except children who are already U.S. citizens or Legal Permanent Residents), even if you are no longer legally married to the child’s parent, and even if the spouse or child does not currently reside with you and/or will not immigrate with you."
"Failure to list all children will result in your disqualification for the visa." - 'all children' here only applies to unmarried children under 21.
So, in your case, you should answer "0" to No.12, and fill out nothing for No.14. In fact, after answering "0" to No.12, you wont even get No.14 question.

Anahit and LucyMo - Thanks very much! Since I was only reading the instructions, its also good to know the website automatically eliminates # 14 if you list zero children. So I take it at the consular interview, you will not be required to provide any info nor will be asked about unmarried family members over 21 since this is not directly related to your DV application.

Also - congrats LucyMo on getting your GC! I can only hope to be in your shoes one day!

Hi Lucy!
I was looking for an input from you after your interview date... didn't find any. Then I noticed you updated your timeline with the date you got your green card. Very happy for you. Enjoy! :)

Thanks! The interview info is in the Family Based GC subforum - it's called "Atlanta AOS, marriage based, detailed story".
