DV- Nativity through Spouse and J1 Waiver

Hi,
I have a question. My husband was selected through the DV Lottery this year. He is actually from India, and ineligible country, but he was allowed to apply for the lottery through me (I am from Turkey). I have a J-1 visa with a 2 year home country residency requirement. It seems like the waiver for the residency requirement may take quite a while. In the meantime, could my husband send his documents to Kentucy Consular or do we need to send our documents together after I get the waiver.

I would appreciate your help on this matter. THANKS!
 
are you (not your husband) doing CP or AOS? If CP, go ahead and apply together. You may get the waiver before your interview. If AOS, you cannot apply for AOS until your favorable recommendation is received. He can send his documents in either case. Congratulations!

If you don't get the waiver and the visa/AOS, you will only be able to get a GC in about 5-6 years.
 
Start the waiver process, because you will need it in either case. The sooner you start, the better chances you have. Once your embassy gets approval from your gov't, make sure they send the letter by Fedex so that you can get the signature confirmation.
