Hi their,

I have a serious issue, i started to full the ds-230 & dsp-122, let's say i'm living abroad in the country (B) and i'm from country (A), and i got married in the country (B) recently just 2 months before the results to a foreigner citizen and the certificate is issued in (B) country, and for some reasons i can't tell my family in country (A) and want to make the interview in (A) and all the document in (A) will not affected by this marriage, so can i write in the forms that i'm single as all the document says in my country (A), is there a chance to be suspended from the lottery, believe it or not i would't lie about all this thing but some serious problems will happen with my family if i'll declare this marriage in (A), is there any similar stories?????? any body can advice and help me out with all this problem??????

Thank you in advance

If I were you I would be honest about your marriage on the forms. You and your wife would both be entitled to Green Cards. The forms you fill out don't need to be shown to your family in country A so you can tell them you are filing as single. You can even prepare a set of forms for their benefit if you need to show them. When you go for the interview in country A can you go without your family being present? If that is possible then you could either take your wife (assuming she can enter the country) or simply fill in the forms saying that she will join you later - you would then be able to sort out her green card as an aos later on, once in America.

If you lie on the forms (i.e. conceal your marriage) you may have problems if you ever want to bring your wife into the USA. If you NEVER intend bringing her to the USA. then you could probably get away with leaving the forms as single and hope no one alerts the American authorities to the lie later on.

One other point, the embassy in your country may be aware of situations like this, so they may even be sympathetic to your plight - but it is important you decide what is the desired end result for your future - and start your relationship with America with that in mind, not the "old thinking" from country A.

PLEASE NOTE - I am not a lawyer - this is just my opinion.

but if i will be honest and write that i'm married, i have to re-new many documents in my country like the id and the birth certificate which could notify my family about the marriage, even if i will hide it from them there is documents connected to them and it should be separate after the marriage (stupid rules), i have no problem for the beginning to go to U.S without my wife, i think i could use a god lawyer later to explain why i did so, but don't you think during the administrative processing the us embassy at my country will check out my residency in the (B) country for such issues??? that's all i'm worry of.

Well, you need to decide whether it is more important to move to the US or to keep your family in country A happy. How exactly do you think USCIS is going to respond when you reveal that your marriage certificate is dated before your forms were sent in as single? You are aware that you can be stripped of your green card for lying on official forms about immigration, aren't you? And yes it is entirely possible that this can be picked up in AP.

And I'm sorry but - in which country exactly do you renew a birth certificate because you got married? My goodness, I do hope that you are not the person mentioned on another forum who married his second wife without divorcing his first and this is what your real problem is....

Why don't you just circumvent all these issues by arranging to have your interview in country B?

I don't know what investigations they will do as part of the application process. I appreciate things can be difficult in some countries with family obligations etc, but it strikes me that lying will probably just come back to bite you in the end. Try and figure out the way you can be honest on the GC forms - and as Susie above says, that is probably best done in country B.

Mr

Pls,I really need ur help. I entered d dv2014 for a frd of mine on his behalf. He also entered d dv2014 nt knowing that I have done that. His elder sisiter also did the same thing. Multiple entries are automatically disqualified from what I know.

Yep I believe he will be disqualified. He had three chances in the selection process where he should only have had one. So - it would be unfair if his selection stands.

U mean d CO is going to detect that. The entries should have been disqualified before the selection. Is the CO going to check him against the unselected illions enteries? Please I need a full explanation.

Well put it this way (this is my theory and I may be mistaken so don't take my word for it) - if the forms go back to KCC they may be cross-checked for multiple entries of the same name and may be knocked out.

I don't know exactly how they detect fraud, but if I were doing it I would probably select the 125k then compare that group against the original 13Million+ entries. In fact, easier still would be to wait to see how many of the 125k actually submit their forms to KCC and look for fraud as they go along. That is easier than comparing 13M against 13M. USCIS publish fraud percentage figures within the selectees and that is one of the reasons that 125k selectees are selected for 50K visas (and the 50K includes family members of the selectees, so of the 125k probably only 30 to 35k are finally getting visas). Your friend should be very careful about how to proceed from here....

One sure way of losing this chance is to lie in your forms. They will eventually catch you, especially if you attempt to bring your wife to US, and then they will ban you from entering US for visa fraud. The only thing you need to show to prove marriage is a marriage license, and also some other unofficial things like photos, trips together, etc. You can do your interview in country B. All documents from country A can be shown in country B interview. If you don't have your civil records in country A updated yet due to the marriage, it can be explained. Hiding your marriage in the forms can't.

i was thinking about making the interview in (B) country with documents from (A) but do you think the marriage certificate of B country can fix the civil docs with single status also with explaining to the consul about the hole situation???

another question, is it possible to make the interview in one country and the spouse makes it in the other although we can submit only one DSP-122 just for the winner or it's possible to make each one DSP-122 form????

I doubt you'll be able to do your interviews separately. As for the single status in your docs, just say you haven't got round to changing your records in country A yet - if you're not resident there this is a simple enough explanation I think?

Btw although KCC is tight lipped on its exact measures for background checks, they do say they work with host countries and I would think one of the most basic background checks would be checking marital status etc. And you sound like you are from a country where they automatically do AP, so I am almost certain the marriage would be picked up.

It's one DS122 for the winner and a DS230 for each person for whom you want a visa.
