Hi everyone,
Any help here would be greatly appreciated, i started this thread after some reading online but found it really difficult to gather the information required:

My parents won the DV lottery (thank GOD), now their interview date is on the 1st of december 2009, their case number is 2010AS000xxxx. WE are from sri lanka.
Now we have recieved the 2nd NL, but the problem is the primary applicant does not meet the required educational qualification, but the applicant has qualified work experience in the past five years, so i need some help from anyone who went through the process of getting by the interview with the job qualifications.
I would like to get a sample of the letter of employment verification as required by the embassy (if any sri lankan experience its most welcome), will they contact current employer? Will they ask for any proof salary?
THe applicant has vocational training, what type of a letter to get from the vocational training place? Any sample letters used in succesful interviews will be very helpful and greatly appreciated.
Thank you all so much in advance,
I hope more people will benefit from this post.

of course you need proof of work...do you really think they will believe any one on their word, without proof it will be a denial! You need tax returns, proof of salary and if the job requires a license in the USA the person might be expected to speak English very well to at least pass the licensing exacm, otherwise they can be denied, just as some one else on this forum was denied.

You can bring proof of Vocational training, but not in all countries a Vocational training will be counted towards educational eligibility and as you stated your country isn't...so that isn't really looked at. Without the job proof, you might only hope for a miracle, but if she/he has the job experience it should be easy to obtain the proof, which will make it a breeze.:)

Good Luck:)

Well he has the job qualification.... I'm wondering how the employment letter must be drafted?
A sample letter to get an idea... He is a managing director if a small business so the proprietor asked how should the letter be?
I also am thinking If it will be a plus to get the document stating he was under vocational training for so long because that's the experience that lead to the current job...
Thanks n btw can you pass me the link to the forum of denial you spoke abt? So we can learn from mistakes ia...

I can't send the link or I have to go through all the posts, you can maybe find it on one of these threads...maybe in the AOS thread, I'm not sure.

The letter should be written on official letter head of the company. Than he needs to add proof of recieved salary, tax returns, etc...as much as possible to proof his job requirement as of the last 5 yrs...or last 2 or 3 depends if he had the job all the time or maybe there was gap in between.
Than he needs to have a job description written by the employer or any other proof what his job is really about. If his job requires a license in the USA he need to speak and read English otherwise he won't be able to pass the licensing exam and still won't be eligible....and don't forget a sponsor or proof of funding if he doesn't have a job already in the USA...

bentlebee were you from Sri lanka?
Yeah I can get all the information regarding job letter
because he manages he has all the tax returns of the store etc
yeah and he can read n write English well...
Kk bro thanks a lot...

Any other views n reviews are very welcome...

I'm a beneficiary.... Not primary applicant...So yeah my name is on application
At the moment I'm not... I lost my status 6 months ago...

So your are anapplicant but not the primary applicant...and your out of status in the USA....if this is true you probably jeapardize the GC for the whole family since you are illegally here and now they will check on it and flag the whole application...you better hire a lawyer and/or expect a denial...overstaying or being illegal as it is called is a ban of 10 years if it is over 6 months!

I'm barely legal.... I have a pending asylum case here.. So it is a protected status...
I'm not 100% illegal.. So now what do you think?

I'm not alawyer...so I have no experience with this. IMO if you case will be approved you will have no issues, but if your case is denied, than you have to leave and will be here illegal if you stay. The only thing I know is that asylum cases are hard to proof and many are denied...the other day there was an asylum case in the news. A christian man who lives in a muslim country and had occured many difficulties and even physical violence, intimidation from authorities...but his case was denied.

tell me about the work and what is the G.C.E. O/L results?

He is managing director of a small auto repair and parts shop...
He joined as sales but now after 14 years he is the manager..
He did the OL long time ago n his results were just two passes chemistry n English

What Occupations will Qualify for the Diversity Visa Program (DV)?

The Department of Labor (DOL) O*Net Online database groups job experience into five "job zones." While many occupations are listed on the DOL Website, only certain specified occupations qualify for the Diversity Visa Program. To qualify for a Diversity Visa on the basis of your work experience, you must, within the past five years, have two years of experience in an occupation that is designated as Job Zone 4 or 5, classified in a Specific Vocational Preparation (SVP) range of 7.0 or higher.

How Do I Find the Qualifying Occupations on the Department of Labor Website?

Qualifying DV Occupations are shown on the Department of Labor O*Net Online Database . Follow these steps to find out if your occupation qualifies: Select "Find Occupations" and then select a specific "Job Family". (For example, select Architecture and Engineering and click "GO". Then click on the link for the specific Occupation (For example, Aerospace Engineers). After selecting a specific Occupation link, select the tab "Job Zone" to find out the designated Job Zone number and Specific Vocational Preparation (SVP) rating range

As Fery said, first check in that DoL database whether you can find the 'specific' job related to the primary appt. (in my understanding its your Dad the PA, correct?)

I wish it would be an easy sailing for you and the family but in my honest opinion it seems a bit hard case to crack. Mainly 'cos as Fery in this forum has said before, SL US Embassy seems NOT to consider just the 'job qualifications' alone for DV eligibility (in the absence of full A/L). When someone asks for eligibility based on 2yr employment route, they seems to check O/L pass in Math and 1st Language as well !! (It seems to me your Dad has done O/L in early 70s or late 60s)

Try get clarifications on this by emailing the embassy. They may be helpful in giving you answers and so you can know what chances you will have. But sometimes they will just say they can not give any 'specific' decisions/answers related to your documents without you fist facing the interview........and that's a Rs. 180k bet !! (Fee of $775x2)

My best advise for you is try get some useful info from them how they will assess job plus O/L results route, since his OL s are so long ago.

Also when you said he has got vocational training, is it from like NAITA or German Tech ?

Anyways, I wish your family Good Luck.

It seems during the interview they will examine how the applicants knowledge is about the English language, etc... You won't be denied if you don't speak English, but it can be a reason for a denial if you job requirement is requiring you to obtain a license in the USA to do your work...without proper English a person can't pass the written test....so just speaking a few words won't help...it mean you need to speak and understand English based on the work you are going to do...

Before we have read about a desperate person who got denied for that reason.

If a person's funding, sponsor, etc...barely passes the limit and on all other front's the applicant also barely can pass or maybe not completely it would be easy for USCIS/CP to deny the person and move forward to the next better qualified candidate...

Since not everything is clearly written there is a lot open for the person who is holding the interview to make a decision based on what his viewing is at the moment....

i have seen manyguys who rejected because of only short of one subject.example 6 g.c.e o/l subjects passed but failed on mathmatics and a other subject.im not discouraging you.and the other thing is its not easy here these days lots of people loosing jobs.very difficult to find jobs.any how i wish you good luck.
