DV-2021 - Double citizenship + marriage question!

Hi everyone, first of all good luck to all of us with this year's lottery.

I have a unique situation and a bit lost. I hope someone could help me.

I am originally Turkish from Istanbul with a Turkish passport. That's why I can apply for the lottery.

However, I'm also a British Passport holder because I've been married to a British Citizen for almost 9 years now.

Things get a bit complicated here; we're in the process of divorcing currently, but by the time when I am filling the application form I won't be single officially. I'm wondering if this could be an issue. The fact that my official partner is British and British people don't have the right to apply for Green Card lottery.

Do you think this could be an issue for my application? I want green card and immigrate to US, my partner doesn't have any intention to immigrate but because we're still officially married I'm a bit confused and scared.

I hope you guys can help.

Thanks in advance.

No issue, whether or not you divorce. (Derivatives are chargeable to applicant country regardless if own country is eligible.)

Where you’re from or which country’s passport(s) you currently hold are not quite relevant, your place of birth determines your eligibility. Your wife or soon to be ex-wife being British has no impact on your application. Since your divorce wouldn’t be final by the time you submit your eDV entry form, you need to ensure your indicate your current marital status as “MARRIED TO A NON USC OR LPR”, and provide her information as your derivative even if you’ll be fully divorced a couple of months or days after your submission.

Thank you so much guys. Ok then I will include her in my application form as well. I was worried that just because she is British maybe US will disqualify my application. But yeah I was born in Turkey and I am originally Turkish, so it should be fine :) fingers crossed :)

Suggest you read the instructions properly before you submit, as it clearly deals with family members born in non eligible countries and some of your comments suggest you haven’t read the full packet. (In fact she could hypothetically even apply herself based on you right now (if you were going to stay married), far from disqualifying you.)

Thanks @SusieQQQ yes you're right, I haven't read the instructions completely yet. I will tonight.

She doesn't care and doesn't want to apply, in fact she doesn't like to live in US. That's why I was worried about being disqualified based on my "current" partner.
