DV-2015 - Marital status

Hi guys!

I'm wondering which marital status should I use applying for DV-2015 if I'm currently in a divorce process. Me and my wife sent our Joint Petition for Summary Dissolution to court and divorce is in pending until the end of December 2013 (6 months). My wife is a GC holder, so she is not eligible for DV anyway. I have Notice of Case Assignment from court, am I still married and should list my wife? I'm confused with "legally separated" marital status, I think it's something different.

I believe in your case you should enter "married" as long as the divorce is not officially finalized. Still, this is just me making my best guess, and it won't hurt if you contact the American embassy in your country and ask before you apply. They should be able to tell you definitively. Good luck!

As Eddy89 says, you should enter married. "legally separated" is only used when you have had a court document your separation. The divorce proceeding is not that - so at this point you are still married.
