DV 2014 CP: OPT and DS230 question

Hi everyone,

My number is 2014AS11XXX(not Iran or Nepal ). I decided to change AOS to CP process, but I haven't re-send my application to KCC yet because of my OPT status is still pending.

I just gradated this May and I am applying my OPT(EAD card). I sent my OPT application(EAD card) in the end of March and USCIS received it on the early April. However, the EAD card application is still under initial review. I afraid if I send out DS-230 to KCC, they will deny my OPT. My work will start from beginning of August which they require me to attend the annual new employee training before starting to work which is written on my contract, so I need have EAD card to work before I get my green card.

I want to make sure if I send DS-230 to KCC, will my OPT be denied? Should I wait my OPT approve and re-send form 122 and DS-230 to KCC for CP process?

You need to stop procrastinating. You number is just about to go current - which means you could either file aos expect KCC to schedule the CP interview this week. However, that won't happen because you are still considering your options. So - time to make your mind up and get on with your chosen plan. If you choose CP, your forms need to be processed by KCC - so you have already caused yourself a delay.

If you plan on changing to CP you had better get your DS-230 and DSP-122 forms sent off to KCC right away. If your your OPT application is going to be denied, it will be denied regardless of when you send in your DS-230 form. You've displayed immigrant intent with the DSP form that you sent in anyways, so if the fear of displaying immigrant intent is what is holding you back from sending in the new set of forms, you might as well bite the bullet and take the next step rather than loose out completely at the end of the day. You need to remember that KCC need enough time to process your forms before your case file gets sent to the applicable embassy/consulate.

Now, you need to decide what to do. If you send your CP paperwork now, you will wait about 4 weeks for them to process those papers. They then might setup a short notice August interview, or more likely ( in my opinion) give you a September interview.

The other thing you could do s start the aos process. With the early filing memo strategy you could file this week and would stand a chance of getting an August interview. Completing aos in time will require more pushing on your side. So, if you are up for battling then aos could be a good option.
