DV-2010 - Urgent Question

Hi There,

Can anybody answer this question. I find out i am a winner in the DV-2010 lottery. The strange thing is, when i initially started with the lottery programs, i used an organization to apply for me.. at that stage i was single in 2006, which i was registered as. So since then i waited to find out if i ever will get selected.

Well, i have found out i am now a winner 3 years later, i was told that my wife can get a green card aswell, which i thought was great, as i was noted by the organisation that did the application .... but obviously i am new to this whole thing, so i did some research on the dv-2010.

My question is, I got married last year, in June 2008, now i am seeing in various web sites that i visit, That i actually am not a winner, because i didnt include my wife in the submission (but i never knew i needed to in the 1st place, the organisation that did my application didnt ask for updated details, so i thought all was in order, in fact i didnt even expect to be a winner).

Will i lose the green card now ? or can i apply for the green card myself without my wife ? ...as its actually only for me, and all will be fine?, and she follows me to the united states with me as a green card holder ?, she is a german citizen, maybe that helps, that maybe she doesnt need a green card (but in the green card application documentation asks for marriage details - so i dont know).

Can anybody answer this question for me ? , need i even start the application ?

That mean, your entry at the eDV was made with wrong information and stated that you are a single. Maybe there some other opinions, but from my point of view this would result in a disqualification - unfortunately :(
 
I kinda agree with Tazmania in terms of the rules, however, I heard many cases in the past that the rules and regulations were ignored. In one case a person got his GC even though he was toooooooooooooooooo late to send the documents to KCC, he even got his visa after October 1st. Please believe me, I know what I'm saying. They sometimes don't care much about the rules.

It's quite possible that you two can get your visas.
If you insist on obeying the rules, one way is that you may get divorce and remarry each other, and use the new date of marriage. However, this may delay your reply to KCC as the procedures may take a few days or weeks.

There might be some other ways around if you are obsessed with living in the USA.
As you said she's a German, she may not need an immigrant visa to be with you, if she is not willingly to work in the USA.

Don't give it up...
