Hello,

I am on case number 2007EU14XXX, which process AOS or CP is better for me? On H1B status.

Thanks,
Robin

First, read what I wrote about the AOS and CP procedures on the link in my signature : General Info for DV winners.

Second, nobody can give you a straight answer. Ultimately, it will be your decision and responsability. We ( forum members ) can only give pros and cons for each, and some advice based on our experience.

You are on H1b, so you have a legal status. So, you could choose AOS.
REgarding previous DV ( except 2006 ), your number would have been low, thus "suitable" for AOS ( see the procedure for details on why ). However, regarding 2006 numbers, your number would be called " late " ( like last trimester ), which might be a problem for AOS.

However, for CP, you have to go back to Europe ( thus, pay for plane tickets ), and take about 2weeks off to have time for both medical and interview, plus a couple of days as a safety measure.

No procedure is "perfect". There are risks and /or drawbacks for both.

In your situation, I would choose CP.

Birth certificate

Hi,

My birth certificate stated my parent's name. However a couple of years ago my dad changced his name, and this has not reflected in my birth certificate. Will I get in trouble for this?

Thanks,
Robin

To Catseyes,
You message is really excellent and helpful.

I have been wondering that if I choose CP, will my current nonimmigrant VISA be affected by the result of the immigration interview? I mean, if something went wrong, and the result of nonimmigration interview is negative,
Can I still use my current unexpired nonimmigrant visa back to USA to continue my education?

Thanks,
Kun
