Dummy question: What is FOIPA?

haoyun04,

Had you notarized your FOIPA request? I sent mine 3 weeks back, but haven't received a reply yet. Wonder if it was because I hadn't notarized it.

I did not notarized it yet but where did you send your FOIPA request to? I am planning to send a letter either to local congressman or TSC office but I am not sure which one yet. I am hoping to get some suggestion from here

My suggestion

Thanks for kris_t100's and others' suggestion, I sent my FOIPA request, and I got the result (which indicates no match was found in FBI database).

My next question then is:

My PD is 7/2003, and I-485 RD is round Feb 2004. my name check was stuck since March 2004. Though the name check has been stuck so long, my I--485 and pd is not current. Can I enquiry this through congressmen or senator or I'd better to go through TSC office?

Any suggestion will be helpful.

haoyun04,

If you have some sort of written confirmation that your namecheck has been pending then I think you can go ahead and contact your congressman. However if you are not sure that your namecheck is pending then it would be wise to wait till you have confirmation. Basically its important to have written proof of your problem before presenting it to a Congressman. Also the fact that the official processing time is not past your filing date works against you. I have been toying with the idea of approaching my Congressman as well but right now I am not sure what the problem is and am waiting to get some sort of proof of the holdup. My date is also not past the processing date so I am weighting my options also.

I got an email from FBI saying no request was sent, and ask me to contact local USCIS. I made an infopass and local USCIS told me that my name check is not complete yet, it has been requested twice for some reason. The request was sent to FBI in March 04.

So I am sure that I am stuck in name check. I will look for local congressman office address and go there in person. (some people suggest go in person is better than calling)

I will try anyway.

Defenitely go to your congressman

haoyun04,

I did not know all the details of your case earlier. After reading your latest post it is clear that you need to contact your congressman. You are caught in this ridiculous finger pointing game between TSC and FBI. They will keep doing this till some pressure is put on them to correct the situation.

Please keep me posted on your progress. I have a bad feeling that I might be in a similar situation and will need to do the same things in a few months.

I am also on the same boat. I received FBI email few weeks ago, said CIS sent them Name Check request at 10/2003, but there was error in the application, so FBI returned it back to CIS, then never received again. I called CIS, one rep checked status for me, and she said she can see there is error in my name check, and she will resubmit it to FBI again. I asked her how long would it take?? she said she doesnt know :-(
I am going to call them again tomorrow, and check if they resubmit my Name Check.

I have two questions here.

1. I sent FOIPA request by fax and received feedback today, it took exactly two weeks.
In the letter, it said: “To promptly response to requests, we concentrate on identifying main files in central records system at FBI headquarters. No records pertinent to your FOIPA request were located by a search of the automated indices”. It also said: “you may file an administrative appeal by writing to the Co-Director, Office of Information and Privacy, United states department of justice…..”
Do I need to continue to do that?

2. I will take you suggestion to contact the congressman & senator. I checked with Google and found the name/phone, for example, in my area, http://www.google.com/local?hl=en&lr=&q=congressman&near=Atlanta,+GA&sa=X&oi=localr

Do I just need to call them and make appointment?

Thank you
