FBI does not necessarily have every police record. It pulls in selective records, BUT then why take chances.

great post sunil - quick one - in the case of I-485 - if the DUI charge is dismissed - would this still be a problem

gcpain i didnt have to apply for h1b extension once i had my EAD card

Hi Dumbo,

When you say 'if the DUI charge is dismissed' , Do you mean the record was expunged OR You were arrested but not convicted.

In the former case since the court has expunged the record it is as good as having no record at all (atleast this is what the lawyer promise). In the latter case even though you do not have a conviction, you do have a police record, It is not deleted automatically.

Dismissal of a DUI case (possible reasons) ...

* Officer did not read you your rights (highly unlikely)
* Two BAC readings are taken (on the spot, and in the police station), these readings should be atleast 15 min apart.
* If you can prove the machines use for BAC were not calibrated properly (service record etc can be obtained from police station)

Ask your friend to get in touch with his/her lawyer and he may be able to advice you better
