Dui on TN "Status"

It is my understanding that non citizens are having their Visa'a prudentially revoked for DUI charges by DOS.

With Canadians not requiring a "VISA" in TN status, have any had their status revoked or has anyone heard of this happening ?

If so..what agency contacted you ?
and was it thru ICE arrest ? email ? mail ?

It doesn't apply to TN1 because the TN1 is not issued in embassy but at the border. Just resolve your case and in no case get another one. which state are you in?
 
The revocation of a visa for a DUI is based on very specific regulations that apply to revocation of visas by the DOS. Even if a non-Canadian were to have their visa revoked, it wouldn't cause the loss of status as long as they remain within the US. Once they leave, however, they would have to return to their original country to apply for a new visa. A single DUI with no aggravating circumstances will not result in being inadmissible to the US, but they will need to carefully document the disposition of the DUI.

So, no, a Canadian can't lose a visa that they never had in the first place. But if the DUI results in them being removable (multiple convictions or a more serious charge like manslaughter DUI) they can be removed like anyone else. If they leave the US voluntarily and attempt to re-enter, the same things that could be scrutinized at a consulate can be scrutinized at the port of entry. Again, a single DUI with no aggravating circumstances should be OK from an immigration perspective. But any time you have criminal charges, it is always prudent to talk to an immigration attorney who can review the details and determine for sure what you need to do to remain admissible to the US.

Have spoken to many...and find in many cases the "real life" experience here is more helpful than their "opinions"...with the current state of immigration actions.

Has anyone heard of a Canadian getting served w/an NTA for DUI ?
