due to Pay-Cut, Sal. less than min-wage

Hi,
I am on H1-B.

Pay in our company had been deffered. Meaning some part of our salary has been withheld to be paid later. We have signed an agreement that lets the employer deffer a part of our salary.


This is from Sep 2004 to Jan 2005. During this time, salary on the paystub shows to be less than the minimum wage for the state.

Feb on wards the pay-cut was partialy relaxed & the pay reached above the minimum wage mark.

Now my pay stubs for these 5 months show less pay (than min wages) & so does my W2.

My question is,

1) Will this create any problems for Green Card

2) Will this create any problems if I change jobs right away, because I have to submit my previous months paystubs?

Minimum wage for most states is around $5-$8 per hour. Are you sure your wage dropped below this limit? or are you talking about prevailing wage?
In any case if your salary dropped below what is listed in the LCA (the salary your employer promised under oath to pay you) you will have to amend the LCA and then possibly amend your h1 as well.
