I filed 485 under investment visa category and its been pending for 3 years. Meanwhile I applied for 485 on employment basis. Now because of the change of rules in investement based visa we may get approval under that and will be conditional for a period of 2 years.
Investment visa is under my wife's name and employment application is under my petition. Under both situation I have applied for all of us. I have following questions for the same.
--If I get approval of my wife's petition and then in that situation can I accept the approval all the approvals except mine.
-- I will wait for my approval to come through under the employment category. The reason for same is that the later will not be conditional while the Investment category approval will be conditional.
Please let me know if anyone has been through a similar situation in past and if not please provide me with suggestions.
