To all
I just wanted to say to all that I am approved and I am relieved that this process is over for me and my wife. Sorry for not updating this portal soon.
Here is short /long version of my story
Came to USA in 1999 with a body shopper who was not ready to file GC and give decent salary to me. Hence wanted to jump ASAP. Some how survived 2000 and 2001 . In the last months of 2001 joined a company who agreed to hire me as perm employee and file for GC.
Applied Labor in EB3 (RIR) in Nov 2001. I was not involved in process due to issues with HR. We did send for Labor in Nov 2001 but Priority date was assigned 05/01/2002. Where did my seven months go I had no idea? After speaking later my HR people told that INS had rejected my labor and then they did reapply. No reasons were provided why INS rejected.
I now took control of things. Went to India got DOB and read up on all things possible. Knowledge is power and nobody takes u for granted. I got labor approved on 09/16/2002. Did not get the receipt for a month. I remember getting angry cursing and being in touch with my lawyer.
Applied for I 140. Company refused to do CP hence had to go for AOS. Also I do not think I-140 an I-485 could be filed together. Any way company refused to sign I-485 papers anyway.
Come end Jan 2003 I got RFE for work Exp. Lawyer just sent back updated resume (I think). I worked .One Week later my I 140 was approved. I was ecstatic.
I was getting ready to file I 485 and I was about in getting married in May 2003. Approvals were raining like dogs and cats. Lawyer said bring wife on H1-B, which was not possible. Advised wait. waited for 3 months.
Went to India came back wife in tow promptly applied for 485, EAD and AP in July 2003.
Waiting period and agony starts. I get RFE on EAD and AP for biographic info. Wife gets EAD and AP within weeks while my EAD, which was applied in July 2003, gets approved in June 2004. My H1 expired in July 2005. Just made in time.
I took more than a year to get 1 FP 09/28/2004. Tried early FP. USCIS kicked us out.
Sent email to FBI in Oct 2004 and reply came back that name check was completed in August 12, 2003. I lost my mind. In the end of 2004 I was the only person in my group who did not get approved. I then stopped checking worrying about GC in Jan 2005. I now had to struggle to keep my job and avoid layoffs. With in 6 months I survived 2 rounds of layoffs. Phew all this just for GC.
Come June 2005, I was depressed and worried for retrogression and I did not have my AP.I spoke to senators and kept calling USCIS and monthly basis from Jan 2005 till June 2005.
Also I got letters from VSC stating pending Service Consideration.
Finally USCIS decided to grants me and wife approval on June 27,2005.
Ironically, we just moved to a new apartment one June 25. Again issues . USICS was not ready to update addresses on approved applications. Post office would not forward approval notices. I thought my lawyer would get notices for both of us. But he gets only mine. In all process, wife process was smooth and used to get approved in weeks. Her second EAD for approved in 4 days( She lost 4 months) .She won all the battles and lost the war. I had a notice in hand and got stamped on July 15,2003. It was 7 less days than 2 years from start to finish.
I am happy to say that wife notice is also in hand, I had to wait for the return mail to show up on VSC and then they updated the address and sent a duplicate copy. Will get her stamping very soon
This is story of me and my wife
I do not think we will go thru it again. It was up and down and some times I did allow the process to affect me.
We both are hoping that all people who are pending do get their approvals fast and please keep hope and my request to all do not let the process get to u.
Keep track to paper work , keeps notes and talk to senators offices. They will help
