Dear Alren, Raju and other CPers,

I have questions on the DS 230.

1. Question 21 a/b - Persons who will accompany to the US now / later date.
I am not sure if my wife and son will accompany me or come after a longer vacation. What should I specify ? Is the DS 230 to be submitted

2. If I sign the DS230 on behalf of my son as a parent guardian, do I need an affidavit from me and my wife

3. Is the DS 230 to be submitted to the NVC or do I just carry this to the Consulate

4. What forms does Packet 3 comprise of?

{If you are sure about their travel plans, just mention 'None' for the item
'Persons who will accompany to the US now' AND mention their names
in the item '.......follow you at a later date'.

I need to tell you that what you mention in these items is not so important
because they will anyway get their VISA packets seperate. At that point
you will have the total freedom to plan as you want. Only condition would
be all of you have to enter US in 6 months from the date of VISA issue.
(2) You have to enter with/or/before your dependents. (3) Your dependents can enter with you/or/after you.

I did not understand the last part of the question, but you have to submit
DS 230 Part I to the NVC and the Part II at the Consulate}

2. If I sign the DS230 on behalf of my son as a parent guardian, do I need an affidavit from me and my wife

{Only you would be executing Affidavits of support (I-134) for both your
wife and your kid. They will need seperate I-134s }

3. Is the DS 230 to be submitted to the NVC or do I just carry this to the Consulate

{You will submit DS 230 Part I to the NVC and carry a filled and un-signed
DS 230 Part II with you to the consulate}

4. What forms does Packet 3 comprise of?

{This is subject to what NVC wants from you. Packet 3 in its barest form
will comprise of only DS 230 Part I for each candidate and the bar-code
sheet that comes in the packet. But if NVC specifically asks that some
documents need to be enclosed, then you will have to send such
documents}

Ds 230 Qts

Hi I am new to the forum. Just got my I 140 cleared at TSC on Aug 19. Opted for CP at Mumbai.

Q. Do I need to fill a DS 230 and I 134 for my son who was born in the US and has a US passport.
 
Just to add to Raju's comments - I have read somewhere in the forum that one can also take with them an UPDATED DS230 PartI form and submit it at the time of interview.. if by the time of your interview date you are sure that your spouse and children will FOLLOW you later and you had already mentioned in the DS230 PartI form sent to NVC that they will travel with you...basically if you want to change your mind either way..

Folks,

quick questions:

1). Does the APPLICANT have to sign the DS 230 Part I form when sending the form back to NVC??


2). My educational and some of the other info will NOT fit in the space provided in DS 230 Part I. Did anyone have the same problem? What was done to solve the problem? Do we include extra pages??

Q14 on DS 230 Part I form??

alren - thanks for your input.

I have one more question - Qs 14 which asks:
Name of Spouse (Maiden or Family Name)

In my Form - would I mention my wife's MAIDEN NAME (surname before marriage) here or should it be her Family Name NOW (after marriage) which is same as mine??

I am a little confused. Please comment.

Quick question:

My lawyer says that I would need to write my name in NATIVE language in Qs 3 of the DS 230 Form?

Did anyone do that? Do you hand write in Hindi on the form??

Please reply ASAP.

{{ I am not sure excatly where the Indian officer asked me and my wife to put the maiden names of our mother's before marriage and also for my wifes maiden name before marriage but we need to put it or they will ask you }}

I did put it im my native lang. I see no harm in writing.
 
Yeah, there is no harm in writing but in case you are not comfortable then you don't have to, it is not mandatory.

This is how you need to fill in

Or you can leave that blank. Since there's no legal sponser for the spouse.

Hi,

We desperately need some good advice from the gurus. Here is a brief summary of our case.

Spouse A applied for 140/CP(12/03 - EB2 TSC) which got approved(8/04) a few days ago and a case number has been created at the NVC (side note - both the USCIS case online status and the AVM do not reflectthe 140 approval but lawyer informed its approved).

Spouse B applied for concurrent 140/485 in 10/2003.

Questions/Help!!!

1) Should Spouse B get added on as dependent to Spouse A application (not done yet) and if so when and how (which forms)? what are consequences/risks? I saw this link (http://www.murthy.com/news/UDaosfam.html) and my understanding based on this is that at best it is risky...

2) Does Spouse B automatically abandon EAD and 485 application if gets added as dependent on Spouse A application? (side note: Spouse A did not apply for EAD/AP based on SPouse B's application).

3) Spouse B got FP notice for 9/16/04!!! should Spouse B go for FP notice or postpone it?

4) I read in this thread that I-864 is not necessary...is that true...can anyone verify?

5) Does Spouse B get added at packet 3 filing? is that same as form ds-230? from the form i saw, nowhere does it ask whether applicant has applied for GC before? is this correct or did i just miss it?


given our time constraint and being its the weekend...its tough to get the right answers (like from a lawyer until Monday)...wud definitely appreciate some advice and get some peace of mind and sleep
