DS 160 Security and Background check section (Criminal Information)

Hi,
I am planning a trip to India this June 2011, and had a question with reference to the "Criminal Section" of the DS 160 form.I had a accident 2 years ago and was arrested and charged with DUI and refusal to submit for breath test.I went to court and the DUI charges were dismissed but had my license suspended for a year for the second charge(refusal to submit for breath test).So i m unsure do i mention yes to this as there was a arrest but DUI charges were dropped.How would this impact my visa stamping?, while every experience is unique at the embassy i was hoping someone could provide with with some insight based on experiences they have had .

Hi, I am in an exactly similar situation. I was arrested in April last year for DWI but my case got dismissed during the very first hearing. I planned a trip next month for first time H1 stamping. I am pretty sure we will have to go through a medical examination process at a hospital appointed by the embassy. There is no certainty on how long it may take for them (embassy) to take a decision after getting our medical results. What consulate are you planning to visit and what date?

It will be highly risky to mention 'no' in the DS160 form, as there is a good chance they will have your arrest record in their system.
