DS -156 Q-36 Urgent........

Hi Guys,

I got my H1B extn and am planning to go to India this month and will be getting my stamping done in delhi.

My question is in DS-156 form, Q 36 says if anybody has filed an immigrant petition on your behalf.

My company has filed I -140 and 485 on my behalf.

Should saying Yes amount to h1 refusal or generating queires.

Did anybody had a similar situation when getting the stamping done in delhi or anywhere in India.

Please reply asap.

Where ever you apply for revalidation Q36 will be common.
You need to give facts.
So it is to be 'YES' since you filed. GC
As h1B nature is of 'duel intent ' you can be on H1 and simultaneously can apply for GC as well.

----- No problem, write YES, you can have H1 and AOS pending at the same time
Did anybody had a similar situation when getting the stamping done in delhi or anywhere in India.
----- Many in your situation got H1Visa stamp revalidated from DOS in US and from US consulates

If employer has filed I-140 for you then you will write YES on DS –156 to a question 36
