driving licencse and EAD card

moved from NY to NJ . Have EAD card valid till JULY 2004 with I-485 pending.

i went to the regular DMV office to get a NJ driving licencse and they asked me to go to their Regional office as I have EAD.

will i get my NJ licencse at the Regional office or will they say that we can't issue as your EAD is valid only for 1 year.

2 years back had similar issues with H1-B .

Anyone with similar experience , kindly suggest
 
I think, you should have status to stay atleast for a year. In Pensylvania, my friend was sent back because his visa was valid for only 3 months and he had applied for extension.

I think you should be ok, but one never knows with immigration.

With an I-485, you do. The EAD confers no status. I'd go down and claim you have an I-485 receipt and nothing else, and see what they do.
 
Got License on EAD

I got my license on EAD in NJ. I am on EAD & my current EAD expires on 7/22/03. I was not sure about one year rule so went to trenton DMV after I got my renewal. I showed them both my current EAD & renewed EAD. My NJ License is valid till 7/22/04 same as my renewed EAD.
Keep a copy of i-485 receipt & be prepared to wait there for a whole day. :)

If your DL expires and u wanna renew then you should have atleast 1 yr validity of ur EAD or H1. Otherwise DMV does not renew the license.

If you have come from another state and you are on H1 (validity expires within 1 yr), you have a problem.

In case of EAD, DMV gives extension to ur license until the date your EAD is valid.

Regional office will issue your DL in NJ based on your EAD card until the expiry date of EAD. Don't forget to carry SSN card with you.
 
venky73 you are wrong...

you don't need to have 1-year validity on either EAD or H-1. they will extend your DL to whatever expiration date on either EAD or H-1. I know this for sure since I renewed my DL back in March this year. And to emphasize, this is in NJ.

Yes, bring your SSN card and H-1 visa (remember you have to bring the one with expiration date on it, i.e. your personal record) or EAD card. i don't think the receipt notice for I-485 is useful. they don't buy the explanation that once I-485 is filed one is in legal status, i.e. if you filed I-485 but you don't have either EAD or H-1 you probably won't get your DL renewed.
 
Well, I just renewed my DL in NJ last week. Amazingly they didn't ask for anything else. The lady took my old DL, sent to cash window, and then picture window, and i had my new DL valid for another 4 years.

then i guess there is no consistent logic on DMV. when i went to renew my DL in March my H-1B visa is expiring end of this year which is shorter than 1 year.

I wonder what kinda status verification an EAD offers the bearer of the card. Apparently, they don't know that the EAD is useless without an underlying immigration (or F1 -- OPT) application.

Trust me - most people in local/state government do not understand anything about immigration.
They don't even understand the difference between a visa and I-94 (arrival/departure record). They think if your visa is expired, then you should be kicked out of country!

This is pathetic!
 
The bottom line is one needs luck and timing. No matter what you do, things doesn't work the same way for everybody.

Different rules in different places, even in the same office every officer interprets in a different way. Right place, right officer, right time, right mood, and luck. Till all these match, you keep on trying at different places.
 
In TX, I can do it online and online doesnt ask for anything..Evn in person, the old license is sufficient. Life is simple in good old Texas, I guess.

I guess that's because the main reason for all this mess is currently livin' in DC!!
 
My suggestion is just go to DMV---fill out the renewal application and DON'T show any documents unless they ask for them. My current EAD expires on August 8th and last month when I went to renew my NJ licence they renewed it upto 4 years. I am so happy that the lady officer didn't ask ANY documents. Each DMV is different in NJ and your renewal is totally depends on the officer's mood. Good Luck!!!

Interestingly, I received a renewel notice from DMV as my License is expiring this month end. The notice just asked whether I am legally here. I completed the application and sent a $24 cheque. I got it renewed for four years. Only thing is it is not photo id. I am planning to go next month to get the photo license .
