Driving Licence in CA

My licence has expired and H4 has gone for renewal since Jan 2004. DMV will not renew my license because I am on pending visa status nor do I have ssn (We came in 1999 Jan and they stopped giving ssn 1999). I am waiting desperatly for ead so that I can get ssn and go for license. We have one car and two kids. Can't buy another car because we don't have a gc and my husband's H1 is till Jan 2005.

The only think that this country gave me was the driving license and they took that away too !

Hi - Why won't they give you a temporary paper license so you can at least take care of your kids ??!?!?!

That's an outrage. You need to contact your congressperson/senators/governator, IMHO.

Anyone else in this awful boat?

jajabhor,
We (my wife and I) feel sorry for you.

140_takes_4ever and pralay,
A Top ranking eductional institute in India had a very bad vice chancellor for 10 yreas. He was more of a politician than educationist and Administrator. He creadted rift between departments... Now I do not see any good research publications from this University..., I have been told that the faculty do not get much funds..., The university lost the race for ever....
Similar thing will occur to any Nation..., if the nation elects (sometimes appointed) a bad administrator and re-elects him/her......

I think California required some type of SSN beginning 1992. I recall thinking that I just got mine before that requirement was made. In IL I had to have a SSN to get my license, even though I turned in my CA license, they still needed to see the number.

People can get DL without SSN in California. All you have to do is to get a letter from SSA office stating that they cannot issue SSN. Any SSA office knows it and they have a standard letter printed for that purpose.

DMV may have to follow some federal regulations (like highway speeds), but DMV's are state government institutions, which is why there's a lot of difference between how the states in terms of what groups and what requirements they impose on giving out licenses. I think for our purposes it's the state's decisions that are much more significant than the federal government's because it's what the states decide to do about issuing licenses to legal immigrants (based on their policies typically about what to do about illegal immigrants driving) that seem to be where we're experiencing all the problems.

There is no federal guideline or regulations for DMV. DMV is a 100% state govt office. And, highway speed - in Montana there is NO speed limit on their freeways. All the states decide their own speed limit on their highways including interstate highways.
I personally don't support the idea of checking the immigration status while giving DL (that's the very reason it's causing us pain). Whoever lives in a state for more than certain period of time should have privilege to get DL - whether they are citizen, legal immigrant or illegal immigrants. And, illegal immigration - that's federal issue and fed should put enough funding to deal with this issue - not state. In fact states like California does not get its fair share when it comes to dealing with immigration.

When the idea of giving DL without checking immigration status came to California, some people gave it a bad label "giving DL to illegal immigrants" - as if this bill was specially designed to give DL for illegal immigrants. But that label is absolutely non-sense. State should give DL whoever lives in that state and needs to drive. Period (and no immigration issue, please).

Becky,
We (both on H1) entered into US in 1998. A number of colleagues I met had their spouses on H4, they produced a letter from SSA that SSN cannot be issued to legal dependents who are not allowed to work. Producing such a letter at DMV got them DL's. To my understanding..., DL was issued to H4 and other dependents... even without SSN, but had to produce extra documentation...

Moving from FL to CA DL Question

My friend is moving from FL to CA, his DL is tied to EAD exp in FL. When he turns in his FL License in CA, will he have to wait 3 months live people are indicating here? Or at least will they issue temporary, or perhaps the final?

I think I-485 application receipt should work in CA. In case of my wife, she applied for DL showing her I-485 receipt and her passport (she did not get her EAD that time) and she got her DL valid for next 6 years.
