I believe after this news from CIS people might have had a lot doubts cleared. But I have two doubts and would like to bring it to your notice.
CIS says:
1. They will adjudicate FY2005 cases as soon as they can (not wait till October 1.). So if you file on 1 April, the CIS will start procesing in April itself.
Doubt: Does that mean if they get the application in April and start processing it. Would the approved case be able to work before Oct1. 2004.
Does it answer the solution to the gray period of 3-4 months for students currently on OPT and may be out of status?
CIS says:
2. The following cases are exempt from cap:
(f) beneficiaries who have been counted once toward the numerical limit, and are the beneficiary of multiple petitions.
Doubt: I filed H1-B petition with my current employer and my case was rejeted, since the "numerical limit" was already reached. So as per the above mentioned statement I will be exempted from the quota of FY2005.
So instead of filing it in April, I can wait till June (OPT expiration) and file for H1 again so as to avoid the gap of 3-4 months..during that time my case (hopefully) would be in process.
If I am exempted with this current employer..would it be applicabe to another employer...if I would like to file H1 with new employer?
